Esta dissertação investiga o atributo da autonomia das agências reguladoras e, em que medida, ele existe e contribui para a produção de uma regulação econômica qualitativamente alinhada ao modelo regulatório idealizado nos anos 1990. Para tanto, a dissertação analisa, com foco nas agências reguladoras federais brasileira, cinco casos concretos de ataques à autonomia das agências reguladoras pelos poderes constituídos (Executivo, Legislativo e Judiciário), pelos órgãos de controle (especificamente, pelo Tribunal de Contas da União) e pelos próprios agentes econômicos regulados. A partir desses casos concretos, a dissertação segue para um prognóstico da autonomia regulatória. Algumas propostas utilizam, além das ferramentas do Direito Administrativo, instrumentos da Ciência Política e da Economia para explicar como a autonomia regulatória pode ser essencial para a resolução de problemas corriqueiros na heterorregulação estatal da economia no Brasil e de que forma a intromissão de outros atores institucionais sobre sua esfera de atuação pode ser mitigada ante a defesa da autonomia regulatória das agências reguladoras.

This study investigates the attribute of regulatory agencies autonomy and, to what extent, it does exist and contribute to the rendering of an economic regulation that is qualitatively aligned with the regulatory model idealized in the 1990s. For this purpose, this research analyzes, focusing on the Brazilian federal regulatory agencies, five specific cases of attacks on the regulatory agencies autonomy by the constitutional powers (Executive, Legislative and Judiciary), control agencies (specifically, the Brazilian Court of Audit) and the regulated economic agents themselves. From concrete cases, this study follows for a prognosis of the regulatory autonomy. Some solutions proposed use, besides the tools of Administrative Law, instruments of Political Science and Economics to explain how regulatory autonomy can be essential for the resolution of ordinary problems in the public regulation of Brazilian economy and also how the intrusion of other institutional actors on its sphere of action can be mitigated in defense of the regulatory agencies autonomy.
