Em contradição com a soberania popular político-decisória declarada no artigo 1º da Constituição de 1988, mediante consenso silencioso da maioria constituinte, foi obstruída a institucionalização de uma permanente participação popular no processo de reforma constitucional. A invocação do poder de reforma da Constituição de 1988, sob processo estritamente parlamentar, não tem sido direcionada à inclusão das gerações futuras em um projeto que se prolonga no tempo, mas se voltado à desconstrução dos compromissos originários. Com a finalidade de contribuir para a solução desse problema, a partir da análise das respostas apresentadas à relação entre Constituição e democracia, por juristas, filósofos e cientistas políticos contemporâneos; dos mecanismos de participação popular na mudança constitucional inseridos em Constituições estrangeiras; da engenharia dos processos constituinte e de reforma da Constituição de 1988; apresenta-se uma proposta, concreta e realizável, de estabelecimento de sistema reflexivo, capaz de assegurar ao povo, mediante esclarecimento político e meios formais vinculantes de ação, o poder de velar pela aprovação de alterações constitucionais que reflitam os juízos ponderados da comunidade política.

Contradicting the sovereignty of the popular political-decision-making, declared in the article 1 of the 1988 Constitution, upon a silent agreement of the majority constituent, the institutionalization of permanent popular participation was obstructed in the process of constitutional reform. Under a strictly parliamentary process, the invocation of the power to reform the 1988 Constitution has not been directed to the inclusion of future generations in a project that expands in time; but it has been directed to the originating commitments' deconstruction. Aiming to contribute to the solution of this matter, by analyzing the diverging answers about the relation between Constitution and democracy, presented by jurists, philosophers and contemporary political scientists, the mechanisms of popular participation in the constitutional change inserted in foreign Constitutions, the engineering of the constituent and reform of the 1988 Constitution processes; a tangible and achievable proposal is presented, of stablishing a reflexive system, able to assure the people, in means of political clarification and formal binding means of action, the power to ensure the approval of constitutional changes that reflect the weighted judgments in the political community.
