Constatando que as correntes da filosofia do direito partem muitas vezes de concepções próprias da filosofia moral, a tese pretende identificar e criticar no neoconstitucionalismo um componente de objetivismo moral. O objetivismo moral seria a corrente da metaética que defende a existência de verdades no campo moral. O objetivismo moral do neoconstitucionalismo consistiria na recuperação da tese jusnaturalista da conexão entre direito e moral e também no papel que confere aos princípios que, mesmo com sua carga valorativa e maior indeterminação, serviriam sempre como parâmetros suficientes para as decisões da justiça constitucional. Baseado numa concepção metaética oposta, o relativismo ou não-cognitivismo, o autor faz a crítica desses aspectos do neoconstitucionalismo. Tal crítica, por sua vez, leva a uma crítica da jurisdição constitucional, que careceria de legitimidade para dar a última palavra nas grandes questões morais ou desacordos morais razoáveis

Jurisprudence currents of thought often make assertions on moral philosophy. This thesis tries to identify and to criticize moral objetivism elements that it intends to see in some modern constitutional theories (neo-constitutionalism). Moral cognitivism or moral objectivism is the school in metaethics that affirms that moral assertions are truth-apt. The cognitivism in neoconstitutionalism would be recognized in the thesis of necessary connection between law and morality, and in the conception of principles that in spite of their indetermination and moral nature would allow judicial decisions. Adopting another metaethics conception, relativism or non-cognitivism, the author criticizes these aspects of neo-constitutionalism. This critique implies a critique of judicial review of legislation that would lack legitimacy when considering great moral issues or reasonable moral disagreements
