A deficiência é uma realidade em nossa sociedade e se manifesta em boa parte da população mundial representando a menor minoria existente. Esse grupo de pessoas, ao longo da história, sofreu grande discriminação e marginalização devido à visão pautada no modelo médico e biológico que tratava a deficiência como um defeito a ser curado. Com a internacionalização dos direitos humanos, a partir da Declaração Universal dos Direitos Humanos, foi possível o desenvolvimento social e reconhecimento do ser humano como sujeito de direitos. A Constituição Federal de 1988 estabeleceu a dignidade da pessoa humana como fundamento do Estado Democrático de Direito e determinou a igualdade de todas as pessoas perante a lei, garantindo os direitos fundamentais a todos. Ademais, a Convenção da ONU sobre as Pessoas com Deficiência, que foi incorporada pelo ordenamento jurídico brasileiro com status de Emenda Constitucional, representou uma conquista no âmbito da proteção das pessoas com deficiência ao analisar a deficiência sob a concepção social, com base nos direitos humanos. E então, em 2015, criou-se o Estatuto da Pessoa com Deficiência para regulamentar a Convenção da ONU no âmbito Nacional, particularmente no que se refere aos temas que foram tratados na Convenção que não havia correspondente na legislação brasileira. Nessa perspectiva, a presente dissertação visa analisar a temática da deficiência sob a luz efetivação do direito à acessibilidade como forma de inclusão social desse grupo de pessoas, a partir do seu reconhecimento como titulares de direitos que devem ser não somente garantidos como efetivados, colocando em evidência tal assunto que é realidade presente em todas as sociedades ao redor do mundo e que merece especial atenção.

Disability is a reality in our society and manifests itself in a large part of the world population, representing the smallest existing minority. This group of people, throughout history, has suffered great discrimination and marginalization due to the view based on the medical and biological model that treated disability as a "defect" to be cured. With the internationalization of human rights, from the Universal Declaration of Human Rights, it was possible to social development and recognition of the human being as a subject of rights. The Federal Constitution of 1988 established the dignity of the human person as the foundation of the Democratic Rule of Law and determined the equality of all people before the law, guaranteeing fundamental rights for all. In addition, the UN Convention on People with Disabilities, which was incorporated by the Brazilian legal system with the status of Constitutional Amendment, represented an achievement in the scope of the protection of people with disabilities when analyzing disability under the social conception, based on human rights. And then, in 2015, the Statute of the Person with Disabilities was created to regulate the UN Convention at the National level, particularly with regard to the topics that were dealt with in the Convention that had no correspondent in Brazilian legislation. In this perspective, this dissertation aims to analyze the issue of disability in the light of the realization of the right to accessibility as a form of social inclusion for this group of people, based on their recognition as holders of rights that should not only be guaranteed, but also put into effect, highlighting this issue that is a reality present in all societies around the world and that deserves special attention.
