O tombamento surge no Brasil com o decreto-lei nº 25, de 30 de novembro de 1937. Por algum tempo único instrumento de preservação do patrimônio histórico e artístico brasileiro, ele foi se cristalizando, na ação e no imaginário, como a ferramenta por excelência de constituição (consagração) de nosso acervo cultural. Nesta trajetória, tombamento se associou umbilicalmente à própria noção de patrimônio e bem cultural, assim como tombar assumiu o sentido de preservar. Em face da ampliação do conceito de patrimônio cultural e, ainda, de sua colocação no topo de nossa hierarquia normativa com a Constituição de 1988, discute-se neste trabalho os limites deste instrumento de preservação, notadamente quando posto em contato com uma realidade que compreende o bem cultural em sua complexa formação, simultaneamente detentor de dimensões materiais e imateriais.

The heritage listing emerged in Brazil with the law nº 25, of November 30, 1937. For many years, this law remained the only legal instrument for the preservation of Brazilian historical and artistical heritage, and it was crystallized, both in the lawsuit and in the collective imaginary, as the main tool for the formation (consecration) of our cultural heritage. On this path, the heritage listing was umbilically connected to the very notion of heritage and cultural asset, as well as listing took on the sense of preserving. In view of the expansion of the concept of cultural heritage and, furthermore, its inclusion at the top of our normative hierarchy with the Constitution of 1988, this work discusses the limits of this instrument of preservation, notably when it is in touch with a reality that comprises the cultural asset in its complex formation, simultaneously possessing material and immaterial dimensions.
