A presente dissertação de mestrado, apresentada como exigência parcial para obtenção do título de Mestre em Direito na área de concentração do Direito do Estado, sob a orientação do Prof. Dr. Roger Stiefelmann Leal, tem como tema a análise das autonomias dos poderes, mais precisamente a autonomia que tanto o Poder Executivo quanto o Poder Legislativo possuem de dispor sobre suas normas de organização e funcionamento. A pesquisa empírica se limita a analisar o exercício da referida autonomia em dois dos três poderes constitucionalmente constituídos, quais sejam, o Executivo e o Legislativo por meio da edição de atos normativos específicos, quais sejam, os regimentos internos e os decretos autônomos. Por meio da análise da teoria da separação dos poderes, pretende-se apreciar, de forma comparativa, a origem, o conteúdo e a natureza jurídica das normas de organização e funcionamento do Executivo e do Legislativo, bem como determinar quais seriam as consequências jurídicas de seu descumprimento. No exame destas consequências jurídicas, será levada em consideração a atuação do Poder Judiciário no espaço de autonomia constitucionalmente reservado aos poderes Executivo e Legislativo. Logo após, será analisada a hipótese da existência de um cerne comum compartilhado pelas normas de organização e funcionamento do Legislativo e do Executivo, que justificaria que as mesmas tivessem suas consequências jurídicas, em caso de descumprimento, tratadas de forma uniforme perante o ordenamento jurídico pátrio.

This dissertation, that is presented as partial requirement for obtaining the degree of Master in Law in concentration area of state law under the guidance of Prof. Dr. Roger Stiefelmann Leal, has as its theme the analysis of the autonomies of the powers, more precisely the autonomy that both the Executive and Legislative Powers have to dispose about their rules of organization and functioning. The empirical research is limited to analyzing the exercise of said autonomy in two of the three constitutionally constituted powers, namely, the Executive and the Legislative, through the publication of specific normative acts, that is, internal regulations and autonomous decrees. By analyzing the theory of separation of powers, it is intended to appreciate, in a comparative way, the origin, content and legal nature of the rules governing the organization and functioning of the Executive and Legislative, as well as determining the legal consequences of its noncompliance. In examining these juridical consequences, the action of the Judiciary Power will be taken into account in the area of autonomy constitutionally reserved to the Executive and Legislative branches. Subsequently, the hypothesis of the existence of a common core shared by the norms of organization and operation of the Legislative and the Executive would be analyzed, which would justify having their legal consequences, in case of noncompliance, treated in a uniform way before the national legal system.
