Este trabalho analisa como a ausência de uma efetiva responsabilidade política no Brasil desequilibra os instrumentos jurídicos de responsabilização dos acusados por ato de corrupção. Em um ambiente de corrupção política, os instrumentos democráticos de controle da atuação de representantes políticos deixam de ser exercidos efetivamente, seja por captura, corporativismo ou mesmo imaturidade institucional. Esse vácuo acaba sendo preenchido pelos expedientes jurídico-sancionatórios de responsabilidade, o que acarreta, na maioria das vezes, severas restrições a direitos e garantias individuais e, por consequência, à própria democracia e ao Estado de Direito. Entende-se que o direito deva regular essa inefetividade da responsabilidade política, mediante expedientes próprios, dissociados da responsabilidade jurídico-sancionatória, resgatando elementos democráticos para o adequado enfrentamento da corrupção política.

This paper analyses the fact that the lack of an effective political liability in Brazil leads to an unbalance to the legal liability mechanisms for those accused of corruption acts. In a political corruption environment, the democratic mechanisms for controlling acts of political agents are not effectively exercised, whether due to capture, corporatism, or even institutional immaturity. This void is filled by legal and litigation mechanisms of liability, often resulting in severe restrictions on individual rights and guarantees and even to democracy itself and the Rule of Law. This paper sustain that the law should regulate such ineffectiveness of the political liability by means of its own mechanisms, unrelated to the legal and litigation mechanisms of liability, by imposing the democratic elements to face political corruption in a proper manner.
