Esta dissertação analisa e propõe uma reflexão a respeito da inter-relação entre o Ministério Público e a democracia, no constitucionalismo brasileiro pós 1988. Para compreender essa relação, fizemos um breve estudo da teoria do contratualismo, da divisão das funções do Estado e do sistema de freios e contrapesos, buscando na formação da sociedade civilizada e na instituição do Estado os princípios que parecem decisivos para o surgimento e solidificação do Parquet. Postas essas premissas, a pesquisa prossegue examinando alguns aspectos da democracia e da instituição que é o mote do trabalho, o Ministério Público. Esta metodologia de estudo permitiu o enfrentamento de algumas questões clássicas preparando as bases e fundamentos para propor uma hipótese para a legitimidade democrática da instituição que foi considerada pela atual Constituição Federal como essencial para a sociedade e importante para o aperfeiçoamento da democracia no constitucionalismo brasileiro.

This study analyses and proposes a reflection regarding the interrelation between the Public Ministry and democracy, in the context of the Brazilian Constitutionalism after 1988. Aiming to understand this relation, we made a brief revision comprising the contractualism theory, State`s functions divisions and the checks and balances system, searching among the civilized society formation and the State institution, the principles that seem mostly decisive to the appearance and strengthening of Parquet. Following those premises, the study investigates some aspects surrounding democracy and the Public Ministry, the institution on which the study is based on. This methodology allowed us to face classic questions who raised the support and base for the proposition of a hypothesis to the democratic legitimacy of the institution considered by the current Federal Constitution as essential for the society and crucial for the improvement of the democracy in the Brazilian constitutionalism.
