A implementação e o exercício de direitos fundamentais prestacionais dependem necessariamente da garantia de recursos financeiros. Não há como se garantir direito à saúde no Brasil sem dispêndio financeiro. Para tanto, o orçamento público é o instrumento no qual estão consubstanciadas as escolhas políticas do legislador, principalmente relativas à arrecadação pública, aos gastos públicos e à dívida pública. É pelo orçamento público que são escolhidos os sujeitos que serão responsáveis pelo pagamento de tributos e quem serão os beneficiários dos serviços públicos sociais. O princípio republicano e o democrático não podem estar dissociados das escolhas políticas e orçamentárias. Este trabalho buscou verificar a possível inconstitucionalidade da modificação do financiamento público federal de saúde instituída pela Emenda Constitucional nº 95 a partir da análise da relação entre o modo de acesso a cargos públicos eletivos, principalmente pela forma de financiamento eleitoral de campanha, e as escolhas políticas do legislador constitucional-orçamentário como fundamento a justificar adoção de medidas de austeridade, como a ocorrida com a instituição do Novo Regime Fiscal. Nesse sentido, buscou-se demonstrar, pela análise da mudança constitucional ao financiamento público de saúde, que somente se respeitarão os fundamentos constitucionais e se alcançarão os objetivos constitucionais quando o acesso a cargos eletivos e as escolhas orçamentárias visarem ao bem comum, respeitarem o princípio republicano e o princípio democrático. A regressividade do sistema tributário e dos benefícios previdenciários e a impossibilidade de deliberação legislativa acerca do pagamento do serviço da dívida pública são consequências da manutenção de privilégios daqueles que cooptaram o poder político pelo poder econômico. Com isso, o resultado obtido foi o reconhecimento da inconstitucionalidade da Emenda Constitucional nº 95/2016 naquilo que modificou o financiamento público de saúde por ser medida de austeridade seletiva, por haver outras opções político-orçamentárias menos gravosas, por violar o direito ao mínimo existencial e o princípio da proporcionalidade, nos subprincípios necessidade e proporcionalidade em sentido estrito, bem como por proteger insuficientemente o direito à saúde.

The implementation and exercise of provisional fundamental rights necessarily depend on the guarantee of financial resources. There is no way to guarantee the right to health in Brazil without financial expenditure. For this purpose the public budget is the instrument in which the legislator's political choices are consolidated, mainly concerning public revenue, public spending and public debt. It is through the public budget that are chosen those who will be responsible for paying taxes and those who will benefit from public social services. The republican and democratic principles cannot be dissociated from political and budgetary choices. This paper sought to verify the possible unconstitutionality of the modification of the federal public health financing instituted by Constitutional Amendment nº 95/2016 from the analysis of the relationship between the mode of access to elected public offices, mainly by the form of electoral campaign financing, and the political choices of the constitutional-budgetary legislator as a basis to justify the adoption of austerity measures, such as that which occurred with the institution of the "New Tax Regime". In this sense it was sought to demonstrate by analyzing the constitutional change to public health financing that constitutional fundamentals will only be respected and constitutional objectives will only be achieved when the access to elective offices and budget choices aim at the public welfare and respect the republican principle and the democratic principle. The regressiveness of the tax system and social security beneficiaries and the impossibility of legislative deliberation regarding the payment of public debt service are consequences of the maintenance of privileges of those who co-opted political power for economic power. With that in mind, the result obtained was the recognition of the unconstitutionality of Constitutional Amendment nº 95/2016 in what changed public health financing as it is a measure of selective austerity, because there are other less restrictive political-budgetary options, for violating the right to the existential minimum and the principle of proportionality, in its sub-principles necessity and proportionality stricto sensu, as well as for insufficiently protecting the right to health.
