A judicialização da assistência farmacêutica pública é um tema da atualidade e que ainda gera controvérsias. A anunciada pacificação jurisprudencial, nos moldes em que vem sendo proposta, tem o objetivo de conter o excesso de judicialização. A finalidade desta pesquisa é demonstrar que esse objetivo é equivocado e não resolverá o real problema, que está nos excessos da judicialização. Para alcançar esse objetivo é preciso antes expor toda a legislação sanitária em vigor, inclusive e principalmente as regras constitucionais, além da evolução histórica jurisprudencial e o seu estado atual. Com esses parâmetros bem assentados, os excessos da judicialização da assistência farmacêutica pública serão identificados e aprofundados sob pontos de vistas pouco ou nada explorados na doutrina. Por fim, será demonstrado de forma prática como o controle judicial da assistência farmacêutica pública pode ser executado de forma ampla e efetiva sem desrespeitar a Constituição e a legislação sanitária.

The judicialization of public pharmaceutical assistance is a topical issue that still generates controversies. The announced jurisprudential pacification, in the form in which it has been proposed, aims to contain the excessive amount of processes. The purpose of this research is to demonstrate that this objective is wrong and will not solve the real problem, which is in the excesses of the parameters of judicialization. To achieve this objective, it is necessary to first expose all the health legislation in force, including and mainly the constitutional rules, in addition to the historical evolution of jurisprudence and its current state. With these parameters well established, the excesses of the parameters of judicialization of public pharmaceutical assistance will be identified and deepened from points of view little or nothing explored in the doctrine. Finally, it will be marked in a practical way how the judicial control of public pharmaceutical assistance can be completed in a broad and effective way without disrespecting the constitution and health legislation.
