Com as crescentes demandas sociais, em que o Estado é o responsável pela prestação de serviços elementares, como saúde e educação, verifica-se uma preocupação cada vez maior com a eficiência da Administração Pública, principalmente, em momentos de crise econômica, que exigem o contingenciamento de recursos orçamentários e resta evidente a necessidade de aprimorar a estrutura e a atividade administrativas. Apesar de iniciativas isoladas durante o século XX, a eficiência só foi elevada a um novo patamar a partir da reforma gerencial da década de 1990. Assim, com a promulgação da Emenda Constitucional nº 19/1998, foi inserido o Princípio da Eficiência no caput do artigo 37 da Constituição Federal, que trata dos princípios regentes da Administração Pública. Preocupação semelhante ocorreu no Direito Europeu com a consolidação do direito fundamental à boa Administração. Essas alterações propiciaram uma nova análise sobre o desempenho do Estado, orientando a atuação do gestor público e dos órgãos de controle. Nesse sentido, o próprio tema do controle se desenvolveu, possibilitando o controle da eficiência. Paralelamente, a Constituição Federal de 1988 deu atenção especial à matéria do controle de constitucionalidade e instituiu no ordenamento jurídico um novo instrumento de controle concentrado, a arguição de descumprimento de preceito fundamental. Após o advento de sua regulamentação (Lei nº 9.882/1999), definiu-se que o novo instituto seria cabível para evitar lesão a preceito fundamental resultante de ato do Poder Público, permitindo a análise de constitucionalidade sobre leis municipais, recepção de normas anteriores à atual Constituição Federal, atos regulamentares e, inclusive, atos materiais. Demonstra-se, então, a possibilidade de considerar a eficiência da Administração como preceito fundamental, para fins de controle de constitucionalidade, via arguição de descumprimento, esclarecendo-se as condições para tal subsunção.

With the growing social demands, in which the State is responsible for the provision of elementary services, such as health and education, there is a major concern with the efficiency of Public Administration, especially in times of economic crisis, which require budget contingency and there is a clear need to improve the public administrative structure and activity. Despite isolated initiatives during the twentieth century, efficiency was only raised to a new level from the management reform of the 1990s. Thus, with the promulgation of Constitutional Amendment n. 19/1998, the Efficiency Principle was inserted in the caput of the article 37 of the Federal Constitution, which deals with the governing principles of Public Administration. Similar concern has occurred in European law with the consolidation of the Fundamental Right to Good Administration. These changes provided a new analysis of state performance, guiding the actions of public managers and control agencies. In this sense, the theme of control has developed, enabling the control of efficiency. At the same time, the Federal Constitution of 1988 gave special attention to the matter of controlling constitutionality and established in the legal system a new instrument of concentrated control, the fundamental precept non-compliance claim. After the advent of its regulation (Law n. 9.882 / 1999), it was defined that the new institute would be appropriate to avoid injury to the fundamental precept resulting from an act of the public authority, allowing the analysis of constitutionality on municipal laws, reception of rules prior to Federal Constitution, regulatory acts and even material acts. It is then demonstrated the possibility of considering the efficiency of the Public Administration as a fundamental precept, for purposes of constitutionality control, through the non-compliance claim, clarifying the conditions for such subsumption.
