A presente dissertação pretende analisar a manifestação da consensualidade na regulação estatal contemporânea, observando, especificamente, a utilização dos instrumentos consensuais nas atividades regulatórias da Agência Nacional de Transportes Terrestres (ANTT). Nesse contexto, visa-se averiguar a relevância do tema da consensualidade no âmbito da atividade regulatória atual e verificar se os instrumentos consensuais, da forma que têm sido regulamentados e implementados na regulação estatal, especialmente no âmbito das agências reguladoras, possuem o condão de proporcionar o efetivo diálogo e interação entre os atores envolvidos no ambiente regulatório, legitimando democraticamente a atividade do ente regulador e tornando a regulação mais eficiente e qualificada. Dessa forma, através da dogmática analítica e normativa, como também de breve estudo de caso, aborda-se o tema, inicialmente, sob um viés teórico, e, em um segundo momento, através de uma perspectiva concreta. Para tanto, divide-se a dissertação em duas partes. Na primeira, composta do segundo e terceiro capítulos, será abordada a consensualidade na regulação estatal, apontando-se, de forma teórica, no que consiste a consensualidade administrativa, sua relevância e formas de manifestação nas atividades do Estado regulador contemporâneo. Na segunda parte, composta dos capítulos quarto, quinto e sexto, será analisada a consensualidade na esfera de atuação da Agência Nacional de Transportes Terrestres (ANTT). O objetivo é abordar os principais instrumentos regulatórios consensuais institucionalizados pela agência, através da análise do seu desenvolvimento nos atos normativos internos por ela editados, além de estudar o caso concreto da atividade regulatória da ANTT no contexto da Política Nacional de Pisos Mínimos do Transporte Rodoviário de Cargas (PNPM - TRC). Serão observados, sob um viés democrático e à luz da sua efetividade, os instrumentos consensuais dos quais se valeu a agência no exercício de suas competências regulatórias.

This dissertation aims to analyze how consensus works in contemporary state regulation, specifically considering the use of consensual instruments in the regulatory activities of the National Land Transportation Agency (ANTT). In this context, the purpose is to ascertain the relevance of the consensus in the current regulatory activity and check if consensual instruments - as they have been regulated and implemented in state regulation, especially in the regulatory agencies - have the ability to provide the effective dialogue and interaction between the players involved in the regulatory setting, democratically legitimizing the activity of the regulator and making regulation more efficient and qualified. Thus, through analytical and normative dogmatics, as well as a brief case study, the topic is initially addressed from a theoretical perspective, followed by a concrete perspective. For this purpose, the dissertation is divided into two parts. The first one, made up by the second and third chapters, consensus in state regulation will be approached, pointing out, theoretically, what administrative consensus is like, its relevance and its forms of manifestation in the activities of the contemporary regulatory state. The second part, which comprises the fourth, fifth and sixth chapters, the consensus under the scope of the National Land Transportation Agency (ANTT) will be analyzed. The objective is to address the main consensual regulatory instruments institutionalized by the agency, by analyzing their development in the internal normative acts, and to study the concrete case of ANTT's regulatory activity in the context of the National Policy of Minimum Freight for Road Cargo Transport (PNPM - TRC). Under a democratic point of view and in the light of their effectiveness, the consensual instruments used by the agency in the exercise of its regulatory powers will be observed.
