Olímpia e o Leviatã são figuras ilustrativas da relação entre o esporte e o Estado. Aqui e alhures, a participação do Estado no domínio esportivo tem sido objeto de críticas e objeções, especialmente fundadas no viés político de suas interferências do passado e no princípio da autonomia das organizações esportivas, estas consideradas por muitos como fiéis protetoras do esporte e de seus atores perante indevidas ingerências. Os recentes escândalos de corrupção e fraude que assolaram o mundo esportivo impuseram, no entanto, a revisão de alguns postulados, dentre os quais a autonomia concebida de tal forma absoluta que garantiu às organizações esportivas uma quase independência das regras postas pelo Estado - e, portanto, uma excessiva liberdade a seus dirigentes para a tomada de decisões. Propõe-se, assim, a revisão do conceito até então predominante de autonomia para focar a proteção no próprio esporte e em sua integridade - ao invés de focá-la nas suas organizações. Para tal fim, considerou-se fundamental o estudo do fenômeno esportivo, das conformações teóricas do princípio da autonomia e dos contornos da integridade na seara esportiva. A tal construção abstrata agregou-se o estudo do sistema jurídico esportivo brasileiro na atualidade e, como hipóteses de comparação, dos sistemas jurídicos norte-americano e francês, e das normativas emanadas das organizações internacionais. Com fundamento nas premissas doutrinárias, jurisprudenciais e legislativas lançadas, passou-se à (re)construção conceitual da autonomia e da relação entre Estado e movimento esportivo, concluindo-se pela necessária participação daquele na estruturação de regras especialmente voltadas à proteção à integridade, sem a necessidade de contrapartida, sob a forma de benesse estatal, para sua imposição a todos os atores responsáveis pela organização do esporte.

Olympia and Leviathan are illustrative figures of the relationship between sport and State. Here and beyond, the State's role on sport's domain has been a target for criticisms and objections, especially based on the political bias of its interferences in the past and on the sports organization's autonomy principle. The sports organizations are considered by many as faithful protectors of sport and its actors before improper interferences. Recent corruption and fraud scandals which devasted the sport's world imposed, however, the review of some postulates, among them the autonomy, which was conceived in a form such absolute that have been guarantying to sports organizations a quasi-independence from the rules placed by State - and, thus, an unreasonable liberty to their officers to decide. The proposal is, so, to review the autonomy definition prevailing until now and focus the protection on the sport itself and its integrity - instead of focusing on its organizations. It's key for this purpose to study the sport's phenomenon, the theoretical configurations of autonomy principle and the outlines of integrity for sport. It's aggregated to this abstract construction the study of the current Brazilian's sports legal system and, as comparation tools, the sports legal system in the USA and France, and the rules emanated from the international organizations. Based on the doctrinaire, jurisprudential and legislative propositions introduced, the autonomy and the relation between State and sports movement were conceptually reconstructed. The conclusion was the necessity of State's involvement on structuring rules specially designed to protect integrity, without the need of counterpart, as an state benefit, for being imposed to all the actors responsible for sports organization.
