O presente trabalho tem por escopo analisar criticamente, e a partir de um ponto de vista interdisciplinar em que confluem elementos das ciências política e sociais, sociologia, administração e gestão pública e direito, o tratamento, a aplicação e a disciplina do controle social. Para tanto, adota-se como paradigma a tecnologia das auditorias democráticas, inovadora e de comprovada eficácia e efetividade em diversos contextos. A obra tem início com um capítulo de aproximação, em que se apresenta o Estado desenvolvimentista e suas inexoráveis interfaces com os valores democráticos fundamentais da legitimidade, responsividade, accountability e eficiência, todos eles necessariamente informadores das apreciações ou mensurações de qualidade da democracia em geral ou da ação pública em especial. Uma vez apresentados e explorados os elementos constitutivos e as características estruturantes dessa espécie de controle, passa-se à invocação -- e estudo -- desse seu eloquente instrumental, de aplicação ainda inédita no cenário brasileiro: as auditorias democráticas. Por meio da utilização de autores estrangeiros e modelos universalmente utilizados nos mais diferentes contextos -- todos eles desenvolvidos e implementados a partir da atuação da organização International IDEA --, passa-se à consideração dos seus elementos e à apreciação da metodologia, sempre de forma a sopesar a sua viabilidade no ambiente jurídico brasileiro. Para tanto, são tomadas em consideração, com mais vagar (porém sem qualquer pretensão de desenvolvimento de um estudo comparado propriamente dito), os casos das auditorias cidadãs britânica (pioneira), porto-riquenha, argentina (representantes latinos) e europeia (única referência em nível supranacional). O capítulo final é dedicado, justamente, e tendo em vista o arcabouço teórico-dogmático, fático e contextual levado a efeito ao longo do trabalho, a avaliar a possibilidade de efetivação de tais auditorias -- independentemente de qualquer alteração legislativa -- no município de São Paulo, assim como à apresentação de um modelo factível, exequível e capaz de viabilizar a obtenção dos relevantíssimos resultados de tal instrumento de controle social.

This thesis aims to critically analyze, from an interdisciplinary point of view in which interacts elements of political and social sciences, sociology, public administration and management and law, the treatment, application and regulation of social control. In this way, it adopts as paradigm the cutting-edge and effective technology of Democratic Audit. The study begins with an approximation chapter in which the developmental state is presented, in addition to its inevitable interactions with the fundamental democratic elements of legitimacy, responsiveness, accountability and efficiency - all inexorable references to any measurement or appreciation of the quality of democracy or of the public action. Once the constitutive elements and the basic characteristics of this type of control are presented, the focus moves to the invocation - and analysis - of one of its most notable tools, not yet applied in Brazil: the Democratic Audits. Through the use of foreign references and universally adopted model - all developed and applied according to the International IDEA inspiration - it evolves to the consideration of the methodology itself, always considering its application in the Brazilian law environment. The references of the United Kingdom (pioneering experience), Puerto Rican, Argentine (Latin expressions) and European Union (the only supranational reference) are taken into account (although the absolute lack of intention to do a comparative study). The final chapter is dedicated - in accordance with the dogmatic, factual and contextual scenario presented - to evaluate the possibility of having one of these audits - without a change of law - in City de São Paulo, in addition to developing a possible and effective model through which Brazilian society can also benefit from this extremely important and useful instrument of social control.
