O presente trabalho tem por objetivo analisar o financiamento público da atividade partidária no Brasil, em especial, após a majoração do aporte de recursos públicos no Fundo Partidário e a proibição do recebimento de doações de pessoas jurídicas, por conta da minirreforma eleitoral de 2015 (Lei no 13.165). O debate sobre o financiamento é indispensável para a consecução de uma reforma política efetiva. Sendo assim, buscou-se encontrar as principais patologias do sistema partidário nacional, com atenção ao multipartidarismo excessivo e artificial e à baixa carga ideológica das legendas. O trabalho parte de duas principais premissas. A primeira trata da hipótese de haver uma relação de causa e consequência entre as patologias mencionadas e o modelo de financiamento adotado no Brasil. A segunda é a hipótese de que as alterações na realidade partidária brasileira - ausência de financiamento empresarial e aumento do financiamento público - tenderiam a aproximar o sistema partidário da teoria de cartelização, cujos postulados serão analisados sob perspectiva jurídica. A metodologia de trabalho consistiu no estudo bibliográfico de obras produzidas nas searas jurídica e da Ciência Política, além de decisões judiciais relevantes. Por fim, buscou-se analisar, criticamente, as principais propostas debatidas no Congresso Nacional sobre o assunto e, sob um viés propositivo, tentou-se contribuir para uma possível reforma que envolva os pilares do financiamento partidário.

The purpose of this work is to analyze the public financing of party activity in Brazil, especially after the increase in public funds coming from the Party Fund and the prohibition of receiving donations from legal entities, due to the 2015 electoral mini-reform (law number 13.165). The debate on funding is indispensable for achieving an effective political reform. Thus, this work has sought to find the main pathologies of the national party system, with attention to excessive and artificial multi-partisanship and the almost inexistence of ideology in the parties. This work starts with two main premises. The first deals with the hypothesis of a cause and consequence relationship between the pathologies mentioned and the financing model adopted in Brazil. The second is the hypothesis that the changes in Brazilian party reality - lack of private-business financing and increased public funding - tend to bring the party system closer to the cartelization theory, whose postulates will be analyzed from a legal perspective. The work methodology has consisted in the bibliographic study of works produced in the legal and Political Sciences, as well as relevant judicial decisions. Finally, we have sought to analyze the main propositions discussed in the National Congress on the subject and, under a propositional perspective, we have tried to contribute to a possible reform that involves the pillars of party financing.
