A presente pesquisa teve por escopo demonstrar a aplicação procedimental das audiências e das consultas públicas de forma a atingir materialmente o direito à democracia em acepção material. Nesse sentido, mostrou-se que os conceitos de democracia formal e de democracia material não são excludentes, mas complementares, sendo que o último surgiu para aperfeiçoamento do modelo, para evitar que a aplicação das normas, sem a existência de critérios valorativos mínimos, cause opressão. Passa-se pela mudança do paradigma da atividade administrativa em virtude da superação de um interesse público apriorístico e estático, sendo certo que este conceito jurídico indeterminado requer constante construção pela Administração Pública, ocasião a qual, em virtude da sociedade plural brasileira, é terreno fértil para a realização das audiências e consultas públicas. Demonstrou-se, por conseguinte, as finalidades jurídica, instrutória e sociológica das audiências e consultas públicas, bem como o procedimento de cada ato deste, conferindo-se interpretação às limitações de rito que mais se adequem ao contraditório material e ao direito fundamental à boa Administração Pública, sob pena da limitação tornar os atos de participação popular em simulacros de abertura democrática da Administração Pública. Debateu-se, ainda, a necessidade da Administração Pública observar as manifestações proferidas nas audiências e consultas públicas, sendo imposto ao Poder Público maior ônus argumentativo na hipótese de discordância com a sociedade civil, bem como a existência de direito subjetivo do cidadão ou entidade participante de ver os argumentos considerados no espectro decisório. Com isso, concluiu-se que as disposições legais que tratam das audiências e consultas públicas garantem a abertura democrática em um plano meramente formal. Para que haja substância de democracia na função administrativa, as normas procedimentais infralegais e decisões tomadas a cabo pelo gestor público devem obedecer ao contraditório material e ao direito fundamental da boa Administração Pública, sob pena de invalidade do ato decisório e impossibilidade de convalidação.

This research's scope was to demonstrate the procedural application of public hearings and consultations to materially achieve the right to democracy in a material and concrete sense. For that matter, it was shown that the concepts of formal democracy and material democracy are not exclusive, but complementary, and that the latter arose to improve the model, to avoid that the application of norms, without the existence of minimum valuation criteria, causes oppression. The paradigm of administrative activity has changed due to the overcoming of an aprioristic and static public interest, and it is certain that this indeterminate legal concept requires constant construction by the Public Administration, which, due to the Brazilian plural society, is fertile ground for public hearings and consultations. It was demonstrated, therefore, the legal, instructive and sociological purposes of public hearings and consultations, as well as the procedure of each act of them, attributing interpretation to the limitations of the rite that best suit the material contradictory and the fundamental right to a good public administration, under penalty of the limitation turning acts of popular participation into simulations of a democratic openness of the public administration. It was also discussed the need for the Public Administration to observe the manifestations given in the public hearings and consultations, being imposed on the Public Power greater argumentative burden in the hypothesis of disagreement with civil society, as well as the existence of subjective right of the citizen or participating entity to see their arguments considered in the decisive spectrum. Hence, it was concluded that the legal provisions about public hearings and consultations ensure democratic openness in a purely formal plan. In order to have the substance of democracy in the administrative function, the infralegal procedural rules and decisions taken by the public manager must comply with the material contradictory and the fundamental right of a good public administration, under penalty of invalidating the decision-making act and impossibility of posterior confirmation.
