Democracia e Constitucionalismo são conceitos que, apesar de não estarem perfeitamente correlacionados, têm seu desenvolvimento histórico entrelaçado. Enquanto o primeiro guarda relação com o autogoverno, a partir de uma lógica de composição de conflitos sociais através da obtenção de maiorias parlamentares, o segundo se pauta pela ideia de restrição ao exercício do poder, pela qual a existência de múltiplos focos de soberania interna permite a imposição, a cada um dos poderes, de freios e contrapesos. Como guardião precípuo deste pacto de fragmentação do poder político, o Supremo Tribunal Federal tem um lócus de destaque no sistema jurídico-constitucional. E, a partir desse espaço, o Pretório Excelso tem a função de garantir a ordem constitucional, o que importa, no mais das vezes, em controlar e intervir na dinâmica de exercício do poder delegado cabível aos demais ramos políticos. Neste contexto, o que se tem observado é a ocorrência de atuações no processo de legiferação, em cada uma de suas fases. Tal panorama, aliás, se dá tanto através do exercício de poderes atípicos quanto pela sua competência de Jurisdição Constitucional. A análise deste papel, que se desenvolve por meio de uma interface com o Legislativo no processo de elaboração das leis, se dará através da teoria do diálogo institucional: por meio dela, e tendo em vista as diferenças de formação e legitimação de cada um dos poderes mencionados, buscar-se-á analisar se e como as deliberações dialogadas em rodadas procedimentais específicas poderão incrementar a produção legislativa, unindo as lógicas de representação popular pautada no autogoverno com a garantia substantiva e procedimental de respeito à Constituição.

Democracy and Constitutionalism are concepts that although they are not perfectly correlated, their historical development is interconnected. Whereas the first is related to the self-government, from a logical of resolution of social conflicts by achieving the parliamentary majority, the second is based on the idea of restriction to the exercise of power, by which the existence of multiple focuses of internal sovereignty allows the application of checks and balances on each of the powers. As a main guardian of such covenant of fragmentation of the political power, the Federal Supreme Court has a relevant locus in the legal-constitutional system. And from this space, the brazilian Supreme Court has the role to ensure the constitutional order, which most times results in controlling and intervening on the dynamics of exercise of the applicable granted power to the other political fields. In this context, it has been observed the occurrence of performances in the lawmaking process, in each of its stages. Such scenario, indeed, takes place either through the exercise of unusual powers or by its competence of Constitutional Jurisdiction. The analysis of such role, which is developed by an interface with the Legislative in the lawmaking process, will be through the theory of the institutional dialogue: through it and aiming at the differences of formation and legitimization of each of the said powers, an effort will be made to analyze if and how resolutions discussed on specific procedural rounds may improve the legislative production, merging logics of popular representation based on the self-government with the substantive and procedural guarantee of respect for the Constitution.
