Este estudo dedica-se à análise do federalismo cooperativo. Muito embora exista uma bibliografia bastante significativa a seu respeito, proliferam-se diferentes concepções, conceitos e compreensões divergentes e antagônicas. Por conta disso, propõe-se revisitar o tema, abordando as incongruências constantes na doutrina, sua origem e as controvérsias atinentes a sua definição e consequências, tais como (i) a existência de uma tendência centralizadora e (ii) a possibilidade desse modelo tolerar instrumentos ou condutas não cooperativas das unidades federativas. Para tanto, o trabalho será pautado a partir de duas dimensões distintas de análise do federalismo cooperativo: a estrutural e a dinâmica. Na primeira delas, esse fenômeno corresponde a uma das possíveis formatações da estrutura federal, estabelecida no texto constitucional. Já, na segunda delas, ele consiste no conjunto de comportamentos dos entes federativos e na relação estabelecida entre eles. A partir disso, procura-se obter subsídios para que seja possível estabelecer conceito, limites e principais características do modelo cooperativo.

This study is dedicated to the analysis of cooperative federalism. Although there is a very significant bibliography about it, there many divergent and antagonistic conceptions, concepts and understandings. Because of this, it is proposed to revisit the theme, addressing the incongruities contained in the doctrine, its origin and the controversies regarding its definition and consequences, such as (i) the existence of a centralizing tendency and (ii) the possibility of this model tolerating uncooperative instruments or conduct of the federative units. For this, the study will be based on two distinct dimensions of analysis: the structural and the dynamic. In the first of these, the cooperative federalism corresponds to one of the possible forms of the federal structure, established in the constitution. In the second one, it consists of the set of behaviors of the federative entities and the relationship established between them. From this, we seek to obtain subsidies so that it is possible to establish the concept, limits and main characteristics of the cooperative model.
