O empoderamento da figura dos aplicadores do Direito institucionalmente autorizados, materializado em uma reconhecida liberdade adjudicatória na resolução dos conflitos humanos frente a enunciados normativos cuja característica de textura aberta é um fato inarredável da modernidade, propicia um grau e extensão aos quais se impõe o reconhecimento da discricionariedade como um fato intermitente da prática jurídica. É de rigor reconhecê-la como uma construção decorrente da dinâmica da atividade intelectual interpretativa do ordenamento, sendo que não possui limites ontológicos em si, salvo os extraídos dos enunciados semânticos do texto, devendo ser identificados os limites postos pela dogmática jurídica analítica, dentre os quais se apresenta o postulado normativo da reserva do possível por meio do artigo 22 do Decreto-lei n. 4.657/1942 - Lei de Introdução às Normas do Direito Brasileiro (LINDB), introduzida pela Lei Federal n. 13.655/2018. Antes considerada uma circunstância fática delimitadora no processo argumentativo de tomada das decisões jurídicas, a reserva do possível se apresenta como norma jurídica estruturante e condicionante da interpretação de regras e princípios de direito público e, por conseguinte, da discricionariedade de julgadores, gestores públicos, órgãos de controle e demais agentes do sistema, notadamente na seara da efetividade de direitos fundamentais sociais. Para esta abordagem, buscou-se promover sucinta análise das premissas e sentidos dos conceitos de discricionariedade jurídica e de reserva do possível, além de comentários às concepções jusfilosóficas de Scott J. Shapiro e de Humberto Ávila, adequadas para as propostas deste trabalho, e ao artigo 22 da LINDB em seus contornos gerais. A metodologia deste trabalho irmana-se ao positivismo jurídico nas linhas clássicas de Hans Kelsen e de H.L.A. Hart e busca subsídios para uma compreensão científica e institucionalmente adequada da teoria da decisão jurídica.

The empowerment of the figure of institutionally authorized law enforcers, materialized in a recognized adjudicatory freedom in the resolution of human conflicts in the face of normative statements whose open texture characteristic is an unavoidable fact of modernity, provides a degree and extension to which the recognition of discretion as an intermittent fact of legal practice. It is rigorous to recognize it as a construction resulting from the dynamics of the interpretative intellectual activity of the order, since it has no ontological limits in itself, except those extracted from the semantic statements of the text, and the limits set by the analytical legal dogma must be identified, among the which presents the normative postulate of the reserve of the possible through article 22 of Decree-Law no. 4,657 / 1942 - Law of Introduction to the Rules of Brazilian Law (LINDB), introduced by Federal Law no. 13,655 / 2018. Before considered a factual limiting circumstance in the argumentative process of making legal decisions, the reserve of the possible presents itself as a structuring legal norm and a condition for the interpretation of rules and principles of public law and, therefore, for the discretion of judges, public managers, agencies control and other agents of the system, notably in the field of the effectiveness of fundamental social rights. For this approach, we sought to promote a succinct analysis of the premises and meanings of the concepts of legal discretion and reserve the possible, in addition to comments on the jusphilosophical concepts of Scott J. Shapiro and Humberto Ávila, appropriate for the proposals of this work, and the 22 of the LINDB in its general outlines. The methodology of this work is linked to legal positivism in the classical lines of Hans Kelsen and H.L.A. Hart and seeks subsidies for a scientifically and institutionally adequate understanding of the theory of legal decision.
