Esta dissertação analisa a repercussão de ideias conservadoras sobre o constitucionalismo liberal, sobre os seus debates e suas práticas. Surgido no século XVIII com fundamento em novos princípios filosóficos, o constitucionalismo liberal difundiu-se por meio dos movimentos revolucionários daquele século. Tendo, em sua gênese, as pretensões de ruptura e inovação, esta dissertação se questiona acerca da permanência de antigos conceitos no novo ambiente teórico e institucional. Para se analisar essa tradição clássica precedente, escolheu-se como representante Edmund BURKE, uma vez que, recepcionando-a e adaptando-a às modernas exigências da liberdade, fundou o conservadorismo propriamente moderno. A partir de BURKE, assim, serão identificadas ideias conservadoras que, mesmo opostas aos fundamentos filosóficos do constitucionalismo liberal, sobre ele se projetaram e permaneceram influentes. O conjunto dessas ideias compõe o que aqui se denomina "constitucionalismo conservador". Os primeiros dois capítulos introduzem a figura de BURKE e abordam questões preliminares acerca do conservadorismo e de sua influência no constitucionalismo e, a partir do terceiro capítulo, cada um se dedica a analisar uma inovação filosófica do liberalismo iluminista, a sua correspondente resposta conservadora e, por fim, as repercussões dessa última no constitucionalismo posterior.

This dissertation analyzes the repercussion of conservative ideas on liberal constitutionalism, its debates and practices. Emerging in the 18th century on the basis of new philosophical principles, liberal constitutionalism was spread throughout the world by the revolutionary movements of that century. As liberal constitutionalism had, in its genesis, the pretensions of rupture and complete innovation, this dissertation questions whether old concepts have remained in the new theoretical and institutional environment. To analyze the previous classic tradition, Edmund BURKE was chosen as a representative, once he welcomed and adapted it to the modern demands of freedom, thus founding a properly modern conservatism. In BURKE, conservative ideas will be identified that, even though opposed to the philosophical foundations of liberal constitutionalism, were projected upon it and remained influential. This set of ideas compose what is here called "conservative constitutionalism". The first two chapters introduce BURKE and address preliminary questions about conservatism and its influence on constitutionalism and, beginning in the third chapter, each one of the followings will be dedicated to analyze one philosophical innovation of Enlightenment liberalism, its corresponding conservative response and, finally, the repercussions of the latter on later constitutionalism.
