O contexto que a pesquisa estuda é o da grande dificuldade de os Municípios prestarem os serviços essenciais à população. Verifica-se a desproporcionalidade entre as obrigações constitucionais estipuladas para os Municípios e a receita que pode por eles ser auferida por sua competência ou transferida pelos outros entes para cumprir essas obrigações. Utilizou-se como metodologia de pesquisa a consulta a livros, artigos, jurisprudências, a estudos que apresentam dados de institutos de pesquisa, de federações industriais, de entes municipais e de instituições públicas e privadas. Foi constatado que os Municípios atualmente, em razão da forma do federalismo fiscal, não têm como se sustentar sozinhos, com cerca de 1/3 deles não tendo condições nem para pagar seus servidores e, por isso, são altamente dependentes, especialmente da União.

The context of the work stems from the great difficulty of the Municipalities providing the essential services to the population. There is disproportionality between the constitutional obligations stipulated for the Municipalities and the revenue that may be earned by them or transferred by other entities. The methodology used its research of books, articles, jurisprudences and data studies of the budget of the Municipality of Manaus and research of public and private institutions. It has been found that the Municipalities currently, due to the form of fiscal federalism, cannot afford to stand alone, with about 1/3 of them not being able to pay their servants and, therefore, are highly dependent especially on the Union.
