Esta dissertação analisa a extensão do direito à indenização por investimentos não amortizados ou depreciados durante a concessão assegurado ao concessionário pela Lei nº 8.987/1995. A referida legislação conferiu ao poder concedente a discricionariedade para definir as condições para exercício desse direito, abrangendo a previsão das situações que levarão à indenização, a indicação dos bens reversíveis, os critérios para mensuração da indenização devida e a forma como deverá ser feito o pagamento. Com foco nas concessões rodoviárias, analisa-se aqui o direito positivo brasileiro, a fim de identificar, em uma perspectiva concreta, a extensão do direito à indenização conferida ao concessionário. A temática é relevante em decorrência da escassez de material bibliográfico acerca da reversibilidade da concessão rodoviária. Embora existam alguns trabalhos a respeito do tema, a maioria deles parte de uma perspectiva mais abstrata, desconsiderando a prática contratual e a recente produção normativa realizada pelas agências reguladoras. Assim, como contribuição, apresenta-se um levantamento sistematizado das principais regras atinentes à reversibilidade da concessão, com foco na conformação do direito à indenização por investimentos não amortizados assegurado ao concessionário.

This dissertation aims to analyze the extent of the right to indemnification granted to the concessionaire for investments not amortized or depreciated during the concession. The legislation assigns to the granting authority the competence to define the conditions for exercising this right, covering the prediction of situations that will lead to indemnification, the indication of reversible assets, the criteria for measuring the indemnity due and how the payment must be made. Focusing on highway concessions, we analyze the Brazilian positive law to identify, in a more concrete perspective, the extension of the right to indemnification granted to the concessionaire. The dissertation is relevant due to the scarcity of bibliographic material about the reversibility of the road concession. Although there are some works on the subject, most of them start from a more abstract perspective, disregarding the contractual practice and the recent regulatory production carried out by sectoral agencies. As a contribution, this dissertation presents a systematic survey of the main rules concerning the reversibility of the concession, focusing on the conformation of the right to compensation for unamortized investments assured to the concessionaire.
