O debate teórico-normativo a respeito da legitimidade democrática da revisão judicial costuma passar ao largo de elementos institucionais. Ao debruçar-se sobre a dificuldade contramajoritária e os binômios última palavra-diálogo, ofusca a importância das regras e procedimentos formais e informais que estruturam a interação nas cortes constitucionaispara a legitimidade democrática de cortes constitucionais constitucionais. Este trabalho procura fazer uma ponte entre o desenho institucional e o debate teóriconormativo sobre legitimidade democrática da revisão judicial, por meio da análise de um elemento específico do desenho institucional do STF: a formação da agenda de julgamentos.

The debate regarding the democratic legitimacy of judicial review usually overlooks institutional elements. While addresses the countermajoritarian difficulty and opposes theories of last-word and theories of dialogue, the debate overshadows the importance of formal and informal rules and procedures that structure the interaction in constitutional courts for the democratic legitimacy of constitutional constitutional courts. The present study seeks to contribute to the research agenda that intends to bridge this gap. For this purpose, I intend to analyze a specific element of the institutional design of the Brazilian Supreme Court (Supremo Tribunal Federal): the devices that allows the judges to control timing of cases.
