A presente dissertação tem por objetivo tratar do tema da retrospectividade da legislação tributária no ordenamento brasileiro. Busca-se analisar se o ordenamento tributário brasileiro contempla uma vedação aos efeitos retrospectivos das normas tributárias, quais os fundamentos normativos que permitem chegar a essa vedação e de que forma se opera a proteção do contribuinte diante dos efeitos retrospectivos vertidos pela legislação tributária. Para tanto, o trabalho parte da conceituação do fenômeno da retrospectividade e da sua distinção frente a fenômenos semelhantes, mas não idênticos, como a retroatividade. Nesse contexto, investigam-se as teorias que deram origem à teoria da irretroatividade das normas e em que medida elas contribuíram para o surgimento do fenômeno da retrospectividade. Assumindo que existe diferença entre retroatividade e retrospectividade, cujo critério de distinção é a consumação da situação jurídica prevista na hipótese legal, o trabalho parte para a análise dos fundamentos encontrados no ordenamento tributário brasileiro que vedam a eficácia retrospectiva da legislação tributária. Ao final, analisa-se a eficácia da proteção existente no ordenamento aplicável aos casos de retrospectividade, a qual opera, essencialmente, por meio da aplicação do princípio da proteção à confiança em conjunto com os direitos e garantias fundamentais de liberdade e propriedade.

The purpose of this research is to deal with the subject of the retrospective effects of Brazilian tax law. It seeks to analyze whether the Brazilian Tax System encompass a prohibition on the retrospective effects of tax rules, what are the normative grounds for such prohibition and how does the protection of the taxpayer works in view of the retrospective effects of the tax legislation. The research starts by analyzing the definition of the retrospectivity phenomenon and its distinction from other phenomena such as retroactivity. In this context, it investigates the theories that gave rise to the nonretroactivity theory and to what extent they contributed to the emergency of the retrospectivity phenomenon. Assuming that there is a difference between retroactivity and retrospectivity, the work investigates the normative grounds found in the Brazilian Tax System that allows for the conclusion that the retrospective effects of the tax legislation are prohibited. Finally, it analyzes how the protection of the taxpayer works in cases involving retrospective effects of the tax legislation, which occurs essentially through the application of the legitimate expectation principle together with fundamental rights such as the rights of freedom and property.
