A presente dissertação de Mestrado utiliza-se da metodologia de estudo de caso único como ferramenta de pesquisa a partir do litígio climático Lliuya v. Rheinisch-Westfälisches Elektrizatätswerk AG (RWE AG), que tramita na Alemanha, para identificar como as teorias do nexo causal dão respaldo à responsabilidade civil ambiental por danos decorrentes das mudanças climáticas no caso eleito, com base nos argumentos invocados pelas partes e pelo Poder Judiciário Alemão. Partindo-se de premissas teóricas para contextualização das mudanças climáticas, responsabilização civil ambiental, danosidade ambiental e litigância climática, identificou-se no caso objeto de estudo as teorias do nexo de causalidade invocadas e realizou-se um cotejo entre as teorias mapeadas e a realidade concreta para se aferir em que medida a construção teórica doutrinária de cada uma das teorias subsume-se ao caso concreto. Ao final, foram identificados precedentes brasileiros em que as teorias do nexo de causalidade foram invocadas no âmbito da responsabilidade civil, buscando-se aferir eventual teoria prevalente e o rigor técnico em que as teorias são aplicadas.

The present Master's dissertation uses the single case study methodology as a research tool based on climate litigation case Lliuya v. Rheinisch-Westfälisches Elektrizatätswerk AG (RWE AG), pending in Germany, to identify how theories of causality support environmental civil liability for damage resulting from climate change in the chosen case, based on the arguments invoked by the parties and the German Judiciary. Starting from theoretical premises for the contextualization of climate change, environmental civil liability, environmental damage and climate litigation, the theories of causality invoked were identified in the case under study and a comparison was made between the mapped theories and reality to assess to what extent the doctrinal theoretical construction of each of the theories is subsumed in the concrete case. In the end, Brazilian precedents were identified in which theories of causality were invoked in the scope of civil liability, seeking to assess any prevailing theory and the technical rigor in which the theories are applied.
