O objetivo do trabalho é introduzir o leitor ao tema da judicialização das mudanças climáticas, entendida como espécie do gênero litigância climática, para, após, identificar suas bases e manifestações no Brasil. O fenômeno, no mundo, remonta ao fim do século passado, mas vem ganhando corpo nos últimos quinze anos, em especial nos Estados Unidos da América, Austrália e países da União Europeia. Desafia a separação dos Poderes, acesso à justiça e as escolhas de política climática de cada país. Primeiramente, o trabalho pretende fixar suas premissas, através da apresentação sobre como as mudanças do clima evoluíram para alcançar grau de consenso na ciência e passar ao debate político, nas Nações Unidas, já como fato, não mais argumento, tendo se tornado objeto do direito internacional. A partir de tal estágio de consenso científico, mas incerteza política, floresce a litigância climática como modo de a sociedade de intervir sobre os rumos da tomada de decisão. A definição do que é litígio climático traz dilema de inclusão e exclusão de casos, por haver diferentes critérios que a doutrina propôs. Há também variadas interpretações sobre as origens do fenômeno e diversas propostas de classificação dos litígios. A pesquisa aponta os desafios que cada classe de casos enfrenta na prática forense e as respectivas tendências. Expõe, a seguir, as análises do impacto da litigância, apesar de ainda inconclusivas na literatura. Aproximando-se da realidade brasileira, detalha as características que a litigância climática exibe no chamado Sul Global, em que direitos humanos e meio ambiente compõem a fundamentação, que nem sempre é explícita ao se referir ao aquecimento global e como combatê-lo, por razões próprias da situação econômica e jurídica dos países em desenvolvimento. Por fim, chegando ao Brasil, a pesquisa delineia as bases de direito material e processual, bem como as predições da doutrina nacional para a formação da judicialização do clima por aqui. Conclui com a apresentação dos casos que, desde há poucos anos, perfazem a litigância climática à brasileira.

This Master dissertation focus on the judicialization of climate change, which is a variety of climate change litigation. The goal is to analyze the phenomenon as it has developed in the world at large in order to answer how and based on what it takes place in Brazil, both actually and potentially. Climate change litigation dates to the end of the last century but has been growing exponentially in number of cases over the last fifteen years, especially in the United States of America, Australia and in the European Union. It challenges the separation of powers, raises issues of access to justice and casts doubt on national governments climate change policy choices. First, the dissertation gives a brief account of how climate change evolved in the field of science to reach a degree of consensus, thus passing to the political debate in the United Nations as a fact and no longer an argument, where it became the focus of international law. From such a stage of scientific consensus, but political uncertainty, climate change litigation flourishes as a way for society to intervene in the direction of decisionmaking. The definition of what counts as climate change litigation is a dilemma since there are both exclusionary and inclusive definitions in the legal literature. There are also different views on the origins of the phenomenon and several typologies for classifying the disputes. The research points out the challenges that each category of cases faces in court, as well as its trends and impacts, although the latter is still unclear. Approaching Brazil, the dissertation details the characteristics that climate change litigation has in the so-called Global South, where human rights and the right to a healthy environment are the main grounds that litigants rely on, and global warming is often implied, but not expressly referred to, in the parties submissions. Arriving in Brazil, the research delineates the substantive and procedural law bases for the judicialization of climate change. It summarizes Brazilian legal scholars predictions for how litigation would unfold in this country. Finally, it concludes with the presentation of the recent cases that have been constituting the Brazilian style climate change litigation.
