A taxa judiciária é um tributo pouco estudado face ao tamanho de sua importância. Pertencente ao gênero taxa, apresenta-se como subespécie especialíssima por conta da afetação de sua receita a um dos Poderes da República. A forma de sua instituição e a dinâmica de sua arrecadação influencia diretamente o exercício de objetivos constitucionais. Prestação devida em razão do exercício de poder/função/atividade jurisdicional pelo Estado, pode determinar maior ou menor acesso à Justiça e influenciar diretamente na extensão da garantia constitucional da autonomia financeira do Poder Judiciário. Apesar da crucial importância, há pouca uniformidade nas muitas taxas judiciárias criadas no país. No caso da Jurisdição, há 27 entes, além da União Federal com competência para tal. De outro lado, os limites postos pela jurisprudência não são suficientes para evitar que os valores de custas iniciais possam variar significativamente segundo o foro e o local em que se propõe uma ação. Essa variação pode resultar em diferentes graus de acesso ao Poder Judiciário nos diversos Estados da Federação, por vezes representando óbice à realização da Justiça e, em outras situações, verdadeiro incentivo a demandas desnecessárias, temerárias ou meramente protelatórias. Na outra ponta, a arrecadação da taxa judiciária é de suma importância à garantia da autonomia do Poder Judiciário, especialmente após o advento do § 2º do art. 98 da Constituição Federal, que vincula a ele a sua destinação, a partir da Reforma do Poder Judiciário, procedida há quinze anos. A partir desses elementos, pretende-se responder às seguintes questões: há limites para fixação do valor da taxa judiciária? Existem patamares máximos? Pode ser cogitada a existência de patamares mínimos?

The brazilian court fee is a tax that can be said little-studied in view of its importance. It is a peculiar fee due to the direct allocation of its revenue to one of the Republic's Powers. The dynamics of its collection directly influences the exercise of one of constitutional objectives Since it is due because of judicial functions exercise by State, it can determine greater or lesser access to justice and directly influence the extent of the constitutional guarantee of the Judiciary's financial autonomy. Despite the crucial importance, there is little uniformity across the nation. In part, this occurs because it a sort of fee, whose institution competence is linked to that defined to the entity providing the respective service. There are 27 States, in addition to the Federal Union, entitled to establish it. On the other hand, the limits set by jurisprudence are not enough to prevent its amount of initial costs from varying incredibly according to State where an action is proposed. This variation may result in distinct degrees of access to the Judiciary in the country, sometimes representing an obstacle to justice or a real incentive to unnecessary, reckless or merely postponing defenses. Moreover, the collection of court fees is truly important to the guarantee of the Judiciary's autonomy, especially after the advent of the Federal Constitution's § 2 of art. 98, which binds it to its allocation, provided fifteen years ago. From these elements, it is intended to answer the following questions: are there limits for setting the value of the court fee? Are there maximum levels? Can the existence of minimum levels be considered?
