Esta tese tem por objetivo analisar o processo de desestatização das ferrovias federais brasileiras, ocorrido durante a década de 1990, pela perspectiva do Direito Econômico. O trabalho parte da premissa metodológica de que a desestatização constitui um processo histórico de organização jurídica do espaço de acumulação capitalista no setor ferroviário. Neste sentido, o primeiro capítulo apresenta uma revisão bibliográfica da historiografia que analisa as ferrovias brasileiras. Em decorrência disso, assume-se a hipótese de que o processo de desestatização pode ser melhor explicado mediante o contraste com o paradigma jurídicoeconômico anterior, conformado pelo processo de constituição da Rede Ferroviária Federal S.A., durante a década de 1950. Para realizar o referido contraste, opta-se pelo estudo de fontes primárias documentais que informaram a constituição daquela empresa estatal e a desestatização das ferrovias. Ao longo do segundo capítulo, busca-se reconstruir o nexo entre ferrovias e desenvolvimento econômico que orientou a criação da Rede Ferroviária Federal S.A.. Neste sentido, procura-se demonstrar que a empresa estatal foi concebida para equilibrar crise e desenvolvimento através do reaparelhamento material e da reorganização administrativa das ferrovias. No terceiro capítulo, busca-se reconstruir tanto os argumentos quanto o fundamento material que serviram de justificativa para a desestatização. Desta forma, infere-se a partir da análise que a organização jurídica do espaço de acumulação capitalista nas ferrovias federais, a partir da década de 1990, convergiu com os interesses privados dos novos concessionários do serviço público de transporte ferroviário. O trabalho finaliza com a apresentação do contraste dos diferentes aspectos dos dois paradigmas jurídicos em análise.

This thesis aims to analyze the privatization process of the Brazilian federal railways, which occurred during the 1990s, from the perspective of Economic Law. The work sets as a methodological premise that privatization is a historical process of legal organization of the space of capitalist accumulation in the railway sector. In this sense, the first chapter presents a bibliographic review of the historiography that analyzes Brazilian railways. It is assumed that the privatization process can be better explained by contrasting it with the previous legal-economic paradigm, which was conformed in the process of founding Rede Ferroviária Federal S.A., during the 1950s. In order to carry out the aforementioned contrast, it is chosen to study primary sources that informed the constitution of that state-owned company and the privatization of the railroads. Throughout the second chapter, it is reconstructed the nexus between railways and economic development that guided the creation of Rede Ferroviária Federal S.A.. In this sense, it is demonstrated that the state-owned company was designed to balance crisis and development through the material re-equipment and administrative reorganization of the railways. The third chapter rebuilds both the arguments and the material basis that served as a justification for the privatization. Therefore, it is inferred from the analysis that the legal organization of the space of capitalist accumulation in the federal railways, from the 1990s, converged with the private interests of the new concessionaires of the public rail transport service. The contrast presentation of different aspects of the two legal paradigms under analysis finalizes this thesis.
