A pesquisa pretende compreender a estrutura normativa e o funcionamento jurídico da dívida pública brasileira, buscando os pressupostos econômicos e políticos que explicam tal ordenação. Partirá, portanto, em suas bases teóricas, do papel do crédito na formação de valor no capitalismo, determinante no desenvolvimento das relações produtivas, comerciais e financeiras, na linha da teoria do valor de Marx. Analisará o papel do Estado Nacional como engrenagem essencial dos ciclos sistêmicos do capitalismo, e como a dívida pública exerce o papel de conteúdo econômico e forma jurídica da acumulação, pela via do fundo público, necessários à competição internacional pelo papel de nação hegemônica nesses ciclos sistêmicos. Deve evidenciar o papel do Brasil nos ciclos sistêmicos britânico e norte-americano e seus projetos de desenvolvimento, refletidos a partir do papel de semiperiferia da economia capitalista mundo, particularmente em sua dimensão financeira, monetária e fiscal da gestão de sua dívida, culminando no denominado Plano Real. Os marcos jurídicos que sustentam a moeda desde então dão o tom de um direito voltado à estabilização da moeda, particularmente em tempos de crise, em detrimento de um papel protagonista no desenvolvimento nacional. Com esse instrumental teórico, a pesquisa partirá para a análise crítica do modo de regulação brasileiro da dívida pública, evidenciando o papel da forma jurídica como regulação da acumulação capitalista, responsável por delimitar o volume e função do fundo público, responsável por proteger e distensionar as contradições sociais inerentes à acumulação, e o universo das finanças privadas. A sucessão de modelos normativos que deságua para o atual, como a Constituição Federal de 1988 e Emendas, as normas que instituíram o Plano Real, a atual composição do Conselho Monetário Nacional e as funções do Banco Central, a restrição federativa à emissão de dívida pelos Estados e Municípios, e as características dos títulos públicos, o poder de emissão, de negociação e de gestão patrimonial decorrente dela, serão analisados à luz da sua adequação do direito ao padrão de acumulação contemporâneo da dívida pública, às "boas práticas" reconhecidas internacionalmente, e se isso impacta ou não em sua sustentabilidade. Por último, abre um debate sobre o processo de novos instrumentos regulatórios internacionais, e sobre a pertinência da adoção de outros modelos de regulação e de formas jurídicas alternativas para uma dívida pública funcional ao desenvolvimento econômico nacional.

The research intends to understand the normative structure and the legal functioning of the Brazilian public debt, seeking the economic and political assumptions that explain this ordering. Therefore, it will start from the theoretical basis of the role of credit in the formation of value in the capitalism, which is decisive in the development of productive, commercial and financial relations, in line with Marx's theory of value. It will analyze the role of the National State as an essential cog in the systemic cycles of capitalism, and how public debt plays the role of economic content and legal form of accumulation through the public fund, necessary for international competition for the role of hegemonic nation in these systemic cycles. It should highlight the role of Brazil in the systemic cycles in England and United States, and its development projects, reflected from the role of semi periphery of the capitalist world economy, particularly in its financial, monetary and fiscal dimension of debt management, culminating in the called "Plano Real" (Real Plan). The legal frameworks that have supported the currency since then set the tone of a right aimed at stabilizing the currency, particularly in times of crisis, to the detriment of a leading role in national development. With this theoretical instrument, the research will start with a critical analysis of the Brazilian regulation of public debt, highlighting the role of the legal form as a regulation of capitalist accumulation, responsible for delimiting the volume and function of the public fund, responsible for protecting and distending the social contradictions inherent in accumulation, and the universe of private finance. The succession of normative models that flow to the current one, such as the Federal Constitution of 1988 and Amendments, the norms that instituted the Real Plan, the current composition of the National Monetary Council and the functions of the Central Bank, the federative restriction to the issuance of debt by States and municipalities, and the characteristics of public securities, the power of issuance, negotiation and asset management arising from it, will be analyzed in light of their adequacy of the right to the contemporary accumulation of public debt, internationally recognized "good practices", and whether or not this impacts its sustainability. Finally, it opens a debate on the process of new international regulatory instruments, and on the pertinence of the adoption of other models of regulation and alternative legal forms for a functional public debt to national economic development.
