Essa tese tem por núcleo central a figura do neoextrativismo e sua relação com a Ordem Econômica Constitucional Brasileira, bem como o papel que este exerce no desenvolvimento socioeconômico do país. O texto se estrutura em dois eixos. Em um primeiro, abordamos em linhas iniciais o contexto de formação do fenômeno a partir dos anos 2000 e apresenta o seu conceito ao leitor, especialmente a partir dos relatos das ciências sociais voltadas para a América Latina. Em momento posterior, avaliamos a ocorrência do neoextrativismo no Brasil, a partir de algumas consequências observadas em três principais dimensões: geográfica, econômica e política. No segundo eixo, avaliamos como a Ordem Econômica Constitucional Brasileira interage com esse formato de exploração de recursos naturais, especialmente os minerais. Para tanto, analisamos tanto a evolução da organização da exploração mineral dada por nosso ordenamento quanto os objetivos e fundamentos constitucionais da República e a estrutura da Ordem Econômica Constitucional brasileira. A tese, em uma visão dialética e crítica, permitiu observarmos que o neoextrativismo é um programa desvinculado dos valores e regras constitucionais. Mais do que isso, e para além de uma visão puramente jurídica, o neoextrativismo não se mostra como ferramenta adequada para a promoção do desenvolvimento socioeconômico da sociedade brasileira.

The central feature of this thesis is the neoextrativism matter and its relation to the Brazilian Constitutional Economic Order, as well as its role in the socioeconomic development of the country. The text is developed in two main directions. The first matter dealt with was the context in which the phenomenon emerged from the 2000s and it is presented to the reader, mainly from social science reports concerning South America. Later, the occurrence of the neoextrativism in Brazil from some consequences stemmed from three main dimensions: geographical, economic, and political was addressed. The second direction is concerned about how the Brazilian Constitutional Economic Order interacts with this approach of natural resources exploitation, mainly the mineral ones. To do so, not only was the growth of the mineral exploitation organization given by our legal framework analyzed, but also the objectives and the Republic legal constitutional grounds and the Brazilian Constitutional Economic order. This thesis, from a dialectic and critical perspective, allowed us to observe that the neoextrativism is not linked to the constitutional values and rules. More than this and beyond the pure and simple legal approach, the neoextrativism does not seem to be an adequate instrument to promote the Brazilian society socioeconomic development.
