O propósito do presente trabalho é identificar a dinâmica de formação da disciplina jurídica do setor portuário brasileiro sob a ótica do direito econômico. As pesquisas histórica e jurídica revelam que a formação dos portos nacionais consagrou a relação centro-periferia, por meio da vinculação da infraestrutura nacional aos interesses internacionais. As sucessivas disputas, com avanços e retrações do interesse nacional, foram refletidas e instrumentalizadas pelo tratamento jurídico do tema, consolidando a submissão nacional. A experiência jurídica internacional demonstra que o setor portuário é tratado como estratégico, com amplo planejamento estatal, preservando-se em grande parte com atuação direta de entidades públicas. A dissonância entre a experiência nacional e internacional revela que uma série de institutos, muitos deles importados como melhores práticas, melhor serviram à justificativa da subserviência do que aos ditames de boas práticas de povos soberanos. Há, sob a luz da Constituição Federal de 1988, um desrespeito à ordem econômica brasileira, caracterizado pela subversão de valores e pelo bloqueio à eficácia dos comandos constitucionais, o que fica demonstrado no presente trabalho.

The purpose of this dissertation is to identify the dynamics in the formation of Brazilian port sectors legal discipline from the perspective of economic law. Historical and legal research reveals that the process of establishment of national ports in Brazil reinforce the core-periphery relationship by linking its national infrastructure to international interests. The continuous disputes with regard to the port sector, characterized by breakthroughs and setbacks from the perspective of the national interest, were reflected in the sectors legal framework, consolidating a structure of national submission. Furthermore, international experience demonstrates that the port sector is typically treated as strategic from a legal standpoint, with extensive state planning and, to a large extent, with direct action by public entities. The dissonance between national and international experiences reveals that several legal concepts, many of which imported as "best practices", were rather used to justify subservience than to actually enable the pursuit of good practices exercised by sovereign nations. In the light of the 1988 Federal Constitution, there is a clear disrespect to the Brazilian economic order, characterized by subverting values and blocking the effectiveness of constitutional commands, which is demonstrated in the present work.
