O presente trabalho tem como objetivo o estudo minucioso dos enunciados prescritivos que giram em torno do ISS e do IOF, em especial quando incidentes sobre a prestação de serviços bancários e sobre as operações de crédito. Para tal desiderato, em um primeiro momento, estabeleceremos as premissas básicas para o desenvolvimento do estudo proposto. Será abordado o tema da linguagem e sua importância para o estudo do direito. Estabelecidos os conceitos fundamentais, estudaremos a competência tributária, de uma maneira mais ampla, ingressando nos conceitos e acepções do Sistema Tributário Nacional e nas limitações ao poder de tributar. Teremos como objeto de estudo as características da competência tributária no ordenamento jurídico e a rigidez do sistema constitucional tributário. Analisaremos, também, a interpretação dos signos constitucionais, característica tipológica ou conceitual dos vocábulos constantes na Constituição Federal de 1988, delineando o nosso ponto de vista sobre a matéria. A fim de traçar o papel da lei complementar em matéria tributária, apresentaremos a construção de conceitos no plano constitucional e a existência de um conceito constitucional de tributo, demarcando os importantes limites para a atuação do legislador infraconstitucional na definição dos impostos que ora a análise se debruça. Ainda no âmbito constitucional, definiremos os termos operação e serviço, desenhando-se dos arquétipos constitucionais dos respectivos tributos à luz do regramento jurídico brasileiro. Em vistas dessas considerações e à luz da Teoria Geral do Direito, visando a construção das regras-matrizes do ISS e do IOF, especificaremos os critérios de antecedente e consequente da norma jurídica tributária. Desenvolveremos aqui um estudo acurado dos institutos (ISS e IOF), bem assim do conflito de competência existente entre tais impostos. Por não se tratar de tema pacificado, tanto na doutrina quanto na jurisprudência, teceremos um panorama dos principais problemas vivenciados pelas instituições financeiras, decorrentes do empasse verificado entre as atividades sujeitas a cada tributo. Com efeito, para a precisa incidência tributária é necessário aferir se as receitas analisadas se originam de prestações de serviços ou, ainda, se se referem a verdadeiras operações creditícias. Realizaremos, outrossim, um estudo pormenorizado à luz do entendimento doutrinário e jurisprudencial.

This thesis aims at developing a thorough study of prescriptive statements concerning the tax on services of any nature, ISS, and the tax on financial operations, IOF, especially when levied on bank services and credit transactions. To reach this aim, first, basic premises will be established. The theme of language and its importance for the study of law will be covered. After establishing these fundamental concepts, fiscal competencies will be addressed in a broader sense, considering concepts and meanings of the National Tax System and the limitations on the power of taxation. The object of study will be the characteristics of fiscal competence at the judicial order and the rigidness of the constitutional tax system. Also, the interpretation of constitutional signs will be analyzed, as a typological or conceptual characteristic of words present in the Federal Constitution of 1988, reaffirming a unique point of view on the issue. To highlight the role of supplementary laws on tax matters, the construction of concepts on a constitutional level and the existence of a constitutional concept of tax will be presented. Still, at the constitutional level, the terms 'transaction' and 'service' will be defined from constitutional archetypes of each separate tax under the Brazilian judicial order. Given these considerations and the General Theory of Law, with the intention of constructing the rule array of ISS and IOF, criteria for antecedents and consequents of tax legal norms will be specified. This detailed study of ISS and IOF includes the conflicts of competence between these two taxes. As the incidence of the two taxes is a controversial theme, both at doctrines and jurisprudences, a panorama of the main issues faced by financial institutions will be presented, as they struggle to identify activities to be levied by each tax. For a precise collection, it is necessary to confirm whether the analyzed revenue comes from services provided or real credit transactions. A detailed study of doctrines and jurisprudences will be developed.
