O Poder Judiciário, no exercício de sua função jurisdicional, pode provocar efeitos indesejados sob a perspectiva da igualdade e da livre concorrência. Isso ocorre, sobretudo, quando afasta, em caráter definitivo e com efeitos prospectivos, a obrigação tributária de determinado contribuinte, que obtém uma decisão final favorável conflitante com a posição final dos Tribunais Superiores. A ação rescisória, nesse contexto, assume importante função de corrigir esses efeitos indesejados, restabelecendo a igualdade ao desconstituir a decisão anterior. O presente estudo tem por objeto analisar os efeitos decorrentes da desconstituição da decisão transitada em julgado, no contexto de relações jurídicotributárias continuativas. Para tanto, inicia-se o trabalho com a investigação das nuances da coisa julgada, suas particularidades em matéria tributária e a sua evolução ao longo de tempo na doutrina e jurisprudência nacionais. Posteriormente, o estudo se propõe a refletir sobre a desigualdade provocada pelo Poder Judiciário. Para tanto, buscaremos amparo na Teoria Geral do Direito e na análise das normas constitucionais e processuais que regem a sistemática processual brasileira, de modo a viabilizar a compreensão de um modelo decisório que pode potencializar a ocorrência da prolação e do trânsito em julgado de decisões conflitantes sobre a mesma matéria. Adiante, examinaremos a ação rescisória, seus contornos jurídicos e os efeitos da rescisão da res judicata. Por fim, analisaremos os efeitos da desconstituição da decisão transitada em julgado, no contexto de relações jurídico-tributárias continuativas. Nesse cenário, buscaremos uma solução que melhor harmonize a tensão estabelecida entre, de um lado, a segurança jurídica e, de outro, a igualdade e a livre concorrência. Também examinaremos as normas que regem o lançamento tributário a fim de verificar as garantias que protegem o contribuinte e o momento a partir do qual o ente tributante retoma o direito de lançar, assim como analisar, os créditos tributários relativos a quais períodos que poderão ser abrangidos pela cobrança realizada pelas autoridades fazendárias.

The judiciary, in the exercise of its jurisdictional function, may provoke undesirable effects from the perspective of equality and free competition. This occurs, especially, when it removes on a definitive basis and with prospective effects the tax obligation of a determined taxpayer, which obtains a favorable final decision that is in conflict with the final position of the Superior Courts. The rescissory action, in this context, assumes an important function of correcting these unwanted effects, reestablishing equality by reversing the previous decision. The purpose of this study is to analyze the effects arising from the reversing of the final decision in the context of continuing legal-tax relations. For this, the work begins with the investigation of the nuances of the res judictata, its particularities in tax matters and its evolution over time on national legal scholarship and case law. Subsequently, the study proposes to reflect on the inequality caused by the Judiciary. In order to do so, we will seek support in the General Theory of Law and in the analysis of the constitutional and procedural rules that govern the Brazilian procedural system, in order to make possible the understanding of a decision model that can make potent the occurrence of the res judicata of conflicting decisions on the same subject. We also shall examine the rescissory action, its legal outlines and the effects of termination on res judicata. Finally, we will analyze the effects of the reversing of the final decision in the context of continuing legal-tax relations. In this scenario, we will seek a solution that better harmonizes the tension established between, on the one hand, legal certainty and, on the other, equality and free competition. We will also examine the tax assessment rules in order to verify the guarantees that protect the taxpayer and the time from which the tax entity retakes the right to assess, as well as the tax credits related to which periods that may be charged by the tax authorities.
