O combate a cartéis internacionais tem emergido como prioridade de política concorrencial em muitas jurisdições desde a década de 1990. No entanto, a despeito do aumento das sanções aplicadas em nível global, a dissuasão ótima da prática permanece um desafio. Dilemas econômicos e jurídicos associados a uma certa contradição histórica entre combate e incentivo a cartéis por parte das diferentes políticas econômicas internas dos países contribuem para reduzir os níveis de cooperação internacional necessários para o endereçamento mais adequado do tema. Essa dissertação discute a experiência brasileira de combate a cartéis internacionais em face dessas questões. Para tanto, apresenta, brevemente, as discussões em torno do conceito de cartel internacional, os fundamentos econômicos que explicam as contradições por trás de políticas de combate e incentivo a cartéis adotadas historicamente pelos países e os impasses jurídicos que que criam obstáculos à cooperação internacional nessa matéria. Posteriormente, analisa a evolução histórica dos objetivos e do regime jurídico da política de defesa da concorrência no Brasil, desde suas origens na década de 1930 até o presente. Ao final, retrata os avanços e desafios da experiência recente de casos e apresenta uma sugestão de agenda para incremento do enforcement da política

The prossecution of international cartels has emerged as a priority in competition policy in many jurisdictions since the 1990s. However, despite the increase in sanctions applied at a global level, optimal deterrence of the practice remains a challenge. Economic and legal dilemmas associated with a certain historical contradiction between prohibition and incentive to cartels presented in internal policies of many countries contribute to reduce the levels of international cooperation required to tackle this conduct appropriately. This dissertation discusses the Brazilian experience in the fight against international cartels in light of these issues. To do so, the dissertation briefly discuss the concept of international cartel, the economic fundamentals that explain the contradictions behind policies to combat and encourage cartels historically adopted by countries, and legal barriers that hinder international cooperation in this matter. Subsequently, it analyzes the historical evolution of the objectives and the legal regime of competition policy in Brazil, from its origins in the 1930s to the present. In the end, it presents the advances and challenges of Brazilian recent case experience and suggests an agenda to improve the enforcement
