Este trabalho investiga em que medida o princípio da proibição de retrocesso social está inserido no ordenamento jurídico brasileiro, inclusive seus reflexos em face do Direito Financeiro, em seu âmbito constitucional, inseridos no Estado Social. A problemática que se propõe reside no fato de que, em razão da escassez dos recursos, são colocadas à frente do poder público as escolhas públicas (trágicas). Nessa medida, o trabalho analisa quais os limites e os critérios de aplicação desse princípio perante o caso concreto, em especial em face das regras de finanças públicas. Entre elas, reflete-se sobre a interação da proibição de retrocesso perante as leis orçamentárias - o Plano Plurianual, a Lei de Diretrizes Orçamentárias e a Lei Orçamentária Anual -, dos mecanismos de flexibilização orçamentária, entre eles, o do contingenciamento, da eleição e execução de políticas públicas. Considerando que compete precipuamente ao Supremo Tribunal Federal a guarda da Constituição, sendo sua prerrogativa dizer a última palavra em matéria constitucional, agregou-se ao estudo a jurisprudência construída pela Corte Suprema sobre a aplicação da proibição de retrocesso social, no sentido de delimitar seu conceito tanto no âmbito doutrinário quanto jurisprudencial.

The present study aims to investigate the extent to which the principle of the prohibition of social regression is inserted in the Brazilian legal system, including, what are its reflexes in the face of the Public Finance Law, its norms were elevated to the Constitutional "status" and are inserted in a Social State. The problem that arises is that, due to the scarcity of resources, public (tragic) choices are placed before the public power. In this sense, this paper seeks to analyze what are the limits and the criteria of application of this principle in specific cases, especially facing public finance rules. Among them, we intend to reflect on the interaction of the non-retrogression principle with the budget laws - the Multi Annual Plan, the Annual Budget Guidelines Law and the Annual Budgetary Law, the mechanisms of budgetary curtailment regulation, among them, the budgetary curtailment, the election and the implementation of public policies. Considering that the Brazilian Federal Supreme Court is primarily responsible for guarding the Constitution, and its prerogative is to set up what matters, the case-law built by the Supreme Court on the application of the non-retrogression principle was added to this study, in order to delimit the concept of the non-retrogression principle.
