Neste trabalho, analisamos se o comportamento dos Estados na esfera internacional, exteriorizado pela sua prática, foi capaz de criar obrigações jurídicas de cooperação para o combate à elisão fiscal internacional. Buscamos responder as seguintes questões: no âmbito do combate ao fenômeno da dupla não tributação da renda propiciado por planejamentos tributários internacionais "agressivos", pode-se dizer que há um dever de cooperação entre os Estados, amparado por fontes não convencionais de produção do Direito Internacional Público? Em caso positivo, qual é o seu conteúdo normativo? Quais são as consequências práticas para os Estados (sobretudo para o Brasil)? Defendemos a tese de que, a partir da prática internacional observada nas últimas décadas oriunda dos esforços realizados pelos Estados e pelas organizações internacionais (OI) para a promoção da cooperação internacional tendo-se em vista o combate à evasão fiscal internacional e a determinadas formas abusivas de planejamento tributário internacional (i.e., elisão fiscal internacional), a transparência e a troca de informações para fins fiscais, na modalidade a pedido - o chamado EOI Standard - se tranformaram em costume internacional. Isso significa que, a despeito da existência de obrigações jurídicas de ordem convencional, a transparência e a troca de informações para fins fiscais se impõem, aos Estados, enquanto conteúdo mínimo de um dever jurídico internacional de cooperação em matéria fiscal, cuja observância é juridicamente obrigatória mesmo àqueles que porventura não tiverem celebrado qualquer convenção internacional neste sentido ou, ainda, que, conquanto tenham-nas celebrado, venham a denunciá-las. O descumprimento de tal dever, que vier acompanhado da caracterização de um dano a um terceiro Estado, poderá dar ensejo à aplicação do instituto da responsabilidade internacional.

Abstract in English
In this thesis, we analyze whether States' behavior, externalized through international practice, aimed to address the so called 'aggressive tax planning' has amounted to a level capable to create duties in the international sphere which would allow us to conclude that it became legally binding. The following questions guided our research: Regarding the actions taken to tackle double non taxation arising from 'aggressive tax planning', are States bound by any legal duty whose source of creation is an unwritten source of Public International Law? In case such a legal duty exist, what is its content? What are the consequences of such a legal duty to the States (specially Brazil)? Based on the close analysis of the international practice observed in the past few decades both from States and international organizations aimed to address tax evasion and 'aggressive tax plannings', it is our understanding that the Transparency and Exchange of Information for Tax Purposes on request - the so called 'EOI Standard' - has become part of Customary International Law. The immediate consequence from the acceptance of such a legal duty is the idea that States are bound to be transparent and to exchange information for tax purposes on request even in the absence of tax conventions. In this context, the EOI Standard is the fundamental content of a legal duty to cooperate in tax matters, which binds all States regardless of the existence of any tax convention in force. The failure to comply with such legal duty imply the applicability of international responsibility to the extent that any third State has a materal or an immaterial damage arising from an unlawfull state act.
