O objetivo deste trabalho é analisar a evolução histórica da disciplina jurídica do capital estrangeiro no sistema bancário brasileiro, relacionando-a à presença quantitativa e expressividade qualitativa dessas instituições, como participação de mercado. O escopo temporal abarca desde os primórdios do seu ingresso no País, durante os anos do Império, até o ano de 2020, com o objetivo de analisar como as raízes dessa disciplina condicionam sua atual conformação. Para tanto, apresenta os diplomas normativos que regeram e ainda regem esse assunto, analisando suas implicações e enfatizando seu caráter de nacionalização ou de internacionalização do sistema bancário, bem como destaca a eficácia da aplicação dessas normas pelas autoridades públicas e, mais recentemente, monetárias.

The aim of this work is to analyze the historical evolution of the legal discipline of foreign capital in the Brazilian banking system, relating it to the quantitative presence and qualitative expressiveness of these institutions, such as market share. The temporal scope covers from the beginning of its entry in the country, during the years of the imperial government (1808), until the year of 2020, in order to analyze how the roots of this discipline condition its current conformation. It presents the normative diplomas that governed and still govern this subject, analyzing its implications and emphasizing its nationalization versus internationalization tendency. It also highlights the effectiveness of the application of these rules by public and, more recently, monetary authorities.
