O financiamento da infraestrutura é pressuposto para o desenvolvimento nacional. Entretanto, o seu incentivo encerra dificuldades, especialmente devido à complexidade dos projetos de longo prazo e à posição periférica que o Estado brasileiro ocupa no sistema mundial. Isto leva à imprescindibilidade da elaboração de um planejamento que envolva a atividade financeira estatal na regulação do crédito e na formação de um funding para o financiamento da infraestrutura, o que, por sua vez, demanda a criação de instrumentos jurídicos capazes de mobilizar o capital público e privado para tanto. Dentro deste contexto e com esta finalidade, a Lei Federal no 12.431/2011 criou as chamadas debêntures de infraestrutura. A partir de uma perspectiva do Direito econômico aplicado, que conjugue uma visão macrojurídica e uma microjurídica, esta tese buscou averiguar a efetividade de tais instrumentos na formação de um funding para o financiamento da infraestrutura nacional entre os anos de 2011 e 2016. O trabalho se divide, basicamente, em três partes. A primeira trata de limitações relacionadas à posição que o Estado brasileiro ocupa na ordem capitalista contemporânea e da questão do desenvolvimento e infraestrutura. A segunda busca elucidar a relevância da atividade financeira estatal, a qual inclui a regulação do crédito, no financiamento de longo prazo brasileiro. A terceira conjuga as anteriores e realiza a avaliação da debênture de infraestrutura como instrumento complementar de formação de funding para o financiamento de longo prazo da infraestrutura nacional entre os anos de 2011 e 2016. A partir da análise obtida por este método, verifica-se que o Estado brasileiro, mesmo inserido perifericamente no sistema capitalista financeiro hierarquizado, mediante sua atividade financeira e planejamento, conseguiu construir um arranjo jurídico parcialmente efetivo para o financiamento de longo prazo com recursos privados entre os anos de 2011 e 2016 por meio da criação das debêntures de infraestrutura inseridas pela Lei Federal no 12.431/2011, sem, contudo conseguir mudar a dinâmica histórica de financiamento público da infraestrutura.

Infrastructure funding is assumed for national development. However, its corresponding inducement raises many difficulties, especially because of how complex long-term projects are and also due to the outlying position of the Brazilian State in the global system. Such scenario makes it crucial to elaborate a planning system that could engage government financial activities in both credit regulation and creation of a funding dedicated to infrastructure, which therefore requires that appropriate legal instruments be created in order to mobilize public and private capital for such. Within such context and aiming at meeting the aforementioned goals, Federal Act No. 12431/2011 created the so-called infrastructure debentures. From an Applied Economics Law perspective, bringing together both macro-legal and micro-legal points of view, this thesis tries to investigate the effectiveness of such instruments in the configuration of a funding for financing national infrastructure between 2011 and 2016. This thesis is comprised of three different parts. The first part approaches the restrictions corresponding to the role the Brazilian State plays in the contemporary capitalist world order, and development and infrastructure matters, as well. The second part aims at clarifying the relevance of the government financial activities, including credit regulation, in the scope of Brazilian long-term funding. The last part of this thesis manages to articulate both previous parts together and assesses the infrastructure debenture as an ancillary instrument in funding formation for the national infrastructure long-term funding between 2011 and 2016. Such assessment shows that the Brazilian State, despite occupying an outlying position in the hierarchical financial capitalist system, by means of its planning and financial activities, has managed to build a partially effective legal arrangement for long-term funding with private resources between 2011 and 2016 thanks to the creation of the infrastructure debentures brought by Federal Act No. 12431/2011, without being able to change the long-lasting dynamics of its government funding of infrastructure nevertheless.
