Historicamente, o desenvolvimento da tecnologia da informação representou desafios ao direito, principalmente quando se verifica a intensidade de como inovações dessa matéria foram inseridas na sociedade a partir do término da Segunda Guerra Mundial, período marcado pela cultura de proteção de interesses de direitos humanos de forma universal e regional. A partir de então, o aumento da capacidade de processamento e armazenagem de dispositivos, e suas características de mobilidade vem contribuindo para peculiaridades que identificam a sociedade pós-moderna, em que os dados gerados em razão das relações entre indivíduos são considerados ferramentas do exercício do poder econômico pelas empresas e pelo Estado. Nesse contexto, destacam-se duas tecnologias que receberão foco neste estudo, sendo a inteligência artificial e o blockchain. Cumpre analisar, portanto, a utilização dessas tecnologias como meios viabilizadores e inibidores do exercício de direitos humanos e possíveis formas de tratamento pelo direito comercial, cabendo reflexão sobre regulação, autorregulação, diplomas de soft law, além da aplicação da teoria do risco do desenvolvimento do direito do consumidor.

Historically, the development of information technology represented challenges to the law, especially when observed the intensity of how innovations in this field were introduced in society from the end of World War II, once such period is marked by the culture of protection of human rights interests in a universal and regional perspectives. Since then, the increase of the processing and storage capacity of devices, and their mobility characteristics, have contributed to peculiarities that identify the postmodern society, in which the data generated by relations among individuals are considered tools of the exercise of the economic power by companies and the State. In this sense, two technologies are highlighted: artificial intelligence and blockchain. Therefore, it is necessary to analyze the use of these technologies as enablers and inhibitors of the exercise of human rights and possible forms of treatment by the commercial law, with reflection on regulation, self-regulation, soft law diplomas and the application of the risks of the development according to the consumer's law.
