O presente trabalho buscou avaliar se as características e o regime particulares das patentes essenciais à implementação de padrões técnicos, em comparação a patentes tradicionais, possibilitam a aplicação da doutrina das essential facilities a disputas de licenciamento sem que haja uma desnaturação do incentivo à inovação. Parte-se de duas noções fundamentais: i) o incentivo à inovação está intimamente relacionado a um ambiente concorrencial hígido e ii) a racionalidade econômica das patentes depende do monopólio jurídico temporário conferido pelo registro, o que seria, a princípio, prejudicado pela doutrina das essential facilities. Para enfrentar o problema proposto, optou-se pelo o método de revisão integrativa da literatura por meio de uma lente dedutiva. Concluiu-se que a doutrina das essential facilities constitui um instrumento útil para firmar uma visão concorrencial a respeito do licenciamento de patentes essenciais. Nesse sentido, a lógica de compartilhamento inerente à doutrina das essential facilities resgata o interesse público existente tanto nas patentes em si, quanto na padronização associada a efeitos de rede, criando-se condições favoráveis à concorrência e, consequentemente, à inovação.

The present work sought to evaluate if the particular characteristics and the regime of the standard essential patents, in comparison to traditional patents, allow the application of the essential facilities doctrine to licensing disputes without denaturing the incentives for innovation. It follows two fundamental notions: i) incentives for innovation are closely related to a healthy competitive environment; and ii) the economic rationality of patents depends on the temporary legal monopoly conferred by the registration, which would in principle be undermined by the essential facilities doctrine. In order to face the proposed problem, the method of integrative literature review with the use of deductive lens was choosen. It was concluded that the essential facilities doctrine is a useful tool for establishing a competition law view on the licensing of essential patents. In this sense, the logic of sharing inherent to the essential facilities doctrine rescues the public interest that exists in the patents themselves, as well as in the standardization associated with network effects, creating favorable conditions for competition and, consequently, innovation.
