O presente trabalho visa analisar o exercício abusivo do Direito de Propriedade Intelectual no setor de biotecnologia como infração à ordem econômica no Direito brasileiro, especificamente sob a perspectiva da recusa de licenciar eventos transgênicos no mercado de soja no Brasil. A importância desse estudo está calcada na ausência de parâmetros claros para a análise antitruste nacional, além da ausência de casos concretos analisados pelas autoridades brasileiras, a despeito da emergência desta prática no mercado. Além disso, o tema também é relevante pela importância de se garantir o acesso ao alimento, insumo essencial à sociedade e cuja crescente apropriação pode representar um óbice ao seu acesso. Para tanto, utilizou-se a revisão da literatura que versa sobre a recusa de licenciar direitos de propriedade intelectual, além da análise dos mais relevantes precedentes jurisprudenciais sobre o tema, com o objetivo de sistematizar parâmetros que auxiliem as autoridades brasileiras a enxergar a recusa no licenciamento de biotecnologia como infração à ordem econômica. Parte-se da limitação da liberdade contratual para, então, explorar em que medidas e em quais hipóteses a recusa de contratar poderia caracterizar infração à ordem econômica. Posteriormente, ao analisar em quais hipóteses a recusa de licenciar direitos de propriedade intelectual poderia configurar abuso de posição dominante, o presente trabalho explora algumas particularidades do mercado de biotecnologia (especificamente do mercado de sementes de soja) para demonstrar que a recusa no licenciamento de eventos transgênicos se reveste de particular periculosidade. A análise do Conselho Administrativo de Defesa Econômica - CADE sobre os possíveis efeitos anticompetitivos da operação de aquisição da Monsanto pela Bayer foi o principal precedente analisado, tendo em vista que oferece um norte para a sistematização dos referidos parâmetros. Por fim, o trabalho permite concluir que o arcabouço legislativo brasileiro poderia conceber parâmetros semelhantes aos utilizados pelos tribunais europeus para a caracterização da recusa de licenciar no mercado de biotecnologia agrícola como infração à ordem econômica.

This work has the purpose of analyzing the abusive exercise of the intellectual property right on biotechnology sector as an infraction of the economic order in Brazilian law, specifically from the perspective of the refusal to license transgenic events in the soybean market in Brazil. The importance of this study is based on the absence of clear parameters for the national antitrust analysis, besides the absence of concrete cases analyzed by the Brazilian authorities, despite the emergence of this practice in the market. In addition, the issue is also relevant because of the importance of ensuring access to food, an essential input to society and whose increasing appropriation might represent an obstacle to its access. For this purpose, a literary review on the refusal to license intellectual property rights was adopted, in addition to the analysis of the most relevant jurisprudential precedents on the subject, in order to systematize parameters that would help the Brazilian authorities to see the refusal to license biotechnology as an infraction of the economic order. Stemming from restrictions to contractual freedom, it was prospected in which measures and in what hypotheses the refusal to contract could be a violation of the economic order. After reflecting this research to the field of intellectual property rights, exploiting in which hypotheses the refusal to license could constitute abuse of dominant position, this work explores some particularities of the biotechnology market (specifically the soybean market) in order to demonstrate that the refusal to license transgenic events is particularly dangerous. CADE's analysis of the possible anticompetitive effects of Monsanto's acquisition by Bayer was the main precedent analyzed, given that it offers a north for the systematization of the referred parameters. Finally, the paper concludes that the Brazilian legislative framework could devise parameters similar to those used by the European courts to characterize the refusal to license in the agricultural biotechnology market as an infraction of the economic order.
