A presente tese tem como objetivo estudar a relação entre fundos de sustentabilidade e o Terceiro Setor. A hipótese trabalhada é que, se ambos forem analisados em conjunto e coexistirem, os fundos de sustentabilidade podem ser um instrumento de fomento do Terceiro Setor, contribuindo para a independência e autossuficiência de suas entidades. A tese analisará inicialmente o panorama do Terceiro Setor no Brasil, incluindo o seu estágio atual e os mecanismos existentes de financiamento. Em seguida, serão estudados os fundos de sustentabilidade, desde as premissas para a sua criação e estruturas jurídicas possíveis até a legislação existente sobre o tema, abarcando a recém editada Lei nº 13.800 de 2019. Por fim, será feito um estudo de caso do panorama do recebimento de doações pela Faculdade de Direito da Universidade de São Paulo, objetivando saber se os fundos de sustentabilidade podem ser utilizados em um ambiente com controvérsias sobre o tema do financiamento privado de instituições públicas. A conclusão é que os fundos de sustentabilidade possuem capacidade de impulsionar o Terceiro Setor e assim devem ser raciocinados quando nele incluídos e também pelo legislador.

This thesis aims to study the relationship between endowments and the Third Sector. The hypothesis worked is that, if both are analyzed together and coexist, endowments can be an instrument for fostering the Third Sector, contributing to the independence and selfsufficiency of its entities. The thesis will initially analyze the Third Sector landscape in Brazil, including its current stage and existing financing mechanisms. Next, endowments will be studied, from the premises for their creation and possible legal structures to the existing legislation on the subject, covering the recently edited Law No. 13,800 of 2019. Finally, a case study of the panorama. of donations received by the Faculty of Law of the University of São Paulo will be made, aiming to ascertain if endowments can be used in an environment with controversies on the subject of private funding on public institutions. The conclusion of the thesis is that endowments have the ability to boost the Third Sector and so should be reasoned upon their inclusion and also by the legislator.
