Dissertação voltada à análise da interação entre a propriedade intelectual e a indústria da moda. Analisamos a estrutura do setor da moda, identificando a importância tanto das tendências quanto da imitação. Avaliamos o aspecto histórico envolvendo direitos de exclusividade e a moda. Verificamos a aplicabilidade de diversos institutos jurídicos "tradicionais" da propriedade intelectual ao mercado da moda, tendo em vista a estrutura sui generis do setor e o paradoxo da pirataria, estudado especialmente por Kal Raustiala. Daí, analisamos modelos jurídicos para a proteção sui generis de artigos da moda pelo direito, avaliando seus pontos positivos e negativos. Estudamos com maior profundidade as proteções concedidas sobre os desenhos industriais não registrados, conforme positivado no Reino Unido e na União Europeia, e as propostas de alteração do regime de copyright dos Estados Unidos. Analisamos, também, a aplicabilidade da concorrência desleal, através da figura da imitação servil, à proteção dos itens de moda, propondo diversos balizadores para adequá-la aos desafios impostos pelo setor.

Abstract in English
Dissertation aimed at analyzing the interaction between intellectual property and the fashion industry. In this paper, we analyze the structure of the fashion industry, identifying the importance of both trends and imitation. We evaluate the historical aspect involving exclusive rights and fashion. We verified the applicability of several "traditional" types of intellectual property to the fashion market, considering the sui generis structure of the sector and the piracy paradox, studied especially by Kal Raustiala. Hence, we analyze legal models for the sui generis protection of fashion items by law, evaluating their strengths and weaknesses. We studied in greater depth the protections granted on unregistered designs, as provided in the UK and the European Union legal systems, and the proposals aiming at changing the United States copyright regime. We also analyzed the applicability of unfair competition, through the figure of slavish imitation, to the protection of fashion items, proposing several guidelines to adapt it to the challenges imposed by the sector.
