A natureza sui generis do software, que cumula características das obras literárias em sua expressão (código-fonte) e funcionalidades eminentemente técnicas, de caráter utilitário, que visam a solução de problemas técnicos, impõe desafio ao legislador, aos tribunais, e ao meio acadêmico, a fim de encontrar proteção jurídica equilibrada para sua tutela. Além da proteção autoral, aos poucos foi reconhecida a possiblidade de patentes de invenção implementadas por software, desde que preenchidos os requisitos básicos da patente. Nada obstante, os efeitos desta proteção dupla não se adequam perfeitamente ao funcionamento prático do programa e às necessidades sociais. O presente trabalho visa realizar estudo, a partir das características técnicas do software, dos preceitos econômicos, constitucionais e concorrências da propriedade intelectual, dos contratos enquanto elementos essenciais da comercialização do software e, por fim, do estudo sobre a possibilidade de cumulação protetiva entre o software e outros institutos de propriedade intelectual, verificando as consequências da referida cumulação. Assim, a problemática deste trabalho é analisar a aplicação da Lei e de institutos jurídicos ao software, bem como às relações jurídico-negociais que envolvem programas de computador, como uma forma de aumentar a segurança jurídica das partes contratantes no mercado, de maneira a fomentar a atividade econômica.

The software's sui generis nature, which combines aspects of literary works in its expression (source code) and eminently technical features, with utilitary qualities, aiming for the solution of technical problems, poses a challenge for law-makers, law courts and academia regarding its fair legal protection.Besides copyright protection, the possibility of patenting softwarerelated inventions was slowly aknowledged, provided that basic patent requirements were met. However, the effects of this double protection do not fit the practical workings and social necessities of the software perfectly. This dissertation aims to investigate the softwares technical aspects, economical values, constitutional precepts, as well as intelectual property, contracts as essential elements to its commercialization and, lastly, the possibility of protective overlap between the software and other objects of intellectual property, in order to analyze possible consequences of said overlap. Thus, this dissertation aims to investigate the application of the law and other juridical institutes related to software, and their juridical and busines relations, as a way to increase juridical security to the parties, in order to promote economical activity.
