A presente tese de doutorado busca contribuir para uma maior efetividade do direito de arrependimento do consumidor no Brasil, tendo em vista que um direito de arrependimento efetivo pode ser um fator de estímulo ao crescimento do comércio eletrônico e à melhoria das relações de consumo no país. Para se atingir essa finalidade, a atual situação do direito de arrependimento no Brasil é analisada de forma crítica e a partir de uma perspectiva prática, procurando-se identificar os fatores que prejudicam seu pleno desenvolvimento, e os que podem eventualmente favorece-lo. Adicionalmente, apresenta-se os resultados de pesquisa empírica sobre o conhecimento e a experiência do consumidor brasileiro em relação ao direito de arrependimento, a qual contou com a participação de quase sete mil consumidores. De posse de todos esses dados e informações, apresenta-se uma tentativa de sistematização do direito de arrependimento do consumidor, na certeza de que uma base teórica sólida é fundamental para que a subsunção do fato à norma apresente resultados satisfatórios.

This thesis seeks to contribute to a greater effectiveness of the consumer right to withdraw in Brazil, given that an effective right to withdraw may encourage the growth of e-commerce and the improvement of consumer relations in the country. To achieve this goal, the current situation of the consumer right to withdraw in Brazil is analyzed critically and from a practical perspective, seeking to identify the factors that hinder its full development, and those that may eventually favor it. Additionally, the results of an empirical research on the knowledge and experience of the Brazilian consumer regarding the right to withdraw, which counted on the participation of almost seven thousand consumers, are presented. In the possession of all these data and information, an attempt is made to systematize the consumer's right to withdraw, in the certainty that a sound theoretical basis is fundamental for satisfactory results in subsuming the fact to the norm.
