Augusto Teixeira de Freitas foi, sem sombra de dúvida, um grande jurista - um expoente no meio jurídico brasileiro oitocentista - e, ao mesmo tempo, personagem importante no processo de codificação do direito civil latino-americano. Aqui, pretende-se confirmar ou refutar a sua originalidade e o alcance internacional das suas principais ideias, especificamente na América Latina e na Alemanha. Em atenção aos limites físicos e temporais desta tese, os esforços foram concentrados no estudo de algumas técnicas, supostamente inovadoras, utilizadas por Augusto Teixeira de Freitas, tanto na Consolidação das Leis Civis como no Esboço do Código Civil, e na consulta das principais fontes (localizadas) relacionadas aos projetos do Código Civil argentino - de autoria do político e jurista argentino Dámaso Simón Dalmacio Vélez Sársfield - e do Código Civil alemão - elaborado por diversos juristas, professores e representantes da sociedade alemã oitocentista.

Augusto Teixeira de Freitas was undoubtedly a great jurist - an exponent in the nineteenthcentury Brazilian juridical environment - and, at the same time, one of the references in the process of codification of civil law in Latin America. The aim of this work is to confirm or refute the originality and international reach of his main ideas, specifically in Latin America and Germany. Considering the physical and temporal limits of this doctoral dissertation, the efforts were concentrated in the study of some supposedly innovative techniques used by Augusto Teixeira de Freitas, both in the Consolidation of Civil Laws and in the Draft Civil Code, and on the analysis of the main sources (available) related to the projects of the Argentinian Civil Code - made by the Argentine politician and jurist Dámaso Simón Dalmacio Vélez Sársfield - and the German Civil Code - elaborated by several jurists, professors and members of the nineteenth-century German society.
