O presente estudo busca contribuir com o debate ético sobre a relação entre homens e animais, abordando o reconhecimento do valor e da dignidade inerente aos animais não-humanos sob o marco civil-constitucional. Inicialmente, faz-se uma incursão histórica pela proteção do animal, destacando desde o antropocentrismo grego, quando o animal era considerado a serviço do homem, até a declaração Universal dos Direitos dos Animais, marco para o reconhecimento da dignidade animal e da proibição dos maus-tratos. Neste contexto, apresenta as principais formulações filosóficas acerca do tema, citando desde alguns filósofos que não consideram os animais dignos de qualquer consideração moral, até aqueles que contribuíram para a mudança paradigmática da visão antropocêntrica. Em seguida, é feita uma análise da constitucionalização do direito animal e da terceirização judiciária, com ênfase nos princípios constitucionais que informam o assunto, como o princípio da dignidade animal, da não-violência, da senciência e do antiespecismo, este último considerado o cerne para o reconhecimento dos direitos fundamentais dos animais. Igualmente, promove uma revisão da jurisprudência nacional e estrangeira sobre o tema, analisando o arcabouço legislativo vigente no Brasil, com destaque para algumas legislações estaduais, consideradas uma das mais avançadas do mundo em relação à matéria. Propõese, enfim, oferecer uma interpretação jurídica do direito civil contemporâneo para que reconheça a dignidade animal e a inclusão dos animais no rol dos sujeitos de direito, concedendo aos mesmos personalidades jurídicas especial, pois atualmente na sociedade contemporânea já existe e essa transformação, e o direito civil é instrumento essencial para tutelar a sociedade.

The present study seeks to contribute to the ethical debate on the relationship between men and animals, by addressing the recognition of the value and dignity inherent to non-human animals under the civil-constitutional framework. Initially, there is a historical incursion for the protection of the animal, highlighting from greek anthropocentrism, when the animal was considered in the service of man, to the Universal Declaration of Animal Rights, a milestone for the recognition of animal dignity and the prohibition of ill-treatment. In this context, it presents the main philosophical formulations on the subject, citing from some philosophers who do not consider animals worthy of any moral consideration, to those who contributed to the paradigmatic change of the anthropocentric view. Next, an analysis of the constitutionalization of animal law and judicial outsourcing is made, with emphasis on the constitutional principles that inform the subject, such as the principle of animal dignity, nonviolence, sentience and antispecism, the latter considered the core for the recognition of the fundamental rights of animals. It also promotes a review of national and foreign jurisprudence on the subject, analyzing the legislative framework in force in Brazil, with emphasis on some state legislation, considered one of the most advanced in the world in relation to the matter. Finally, it is proposed to offer a legal interpretation of contemporary civil law so that it recognizes animal dignity and the inclusion of animals in the list of subjects of law, granting the same Special Legal Personality, because currently in contemporary society already exists and this transformation, and civil law is an essential instrument to protect society.
