A presente tese busca analisar a forma como o imperador Marco Aurélio fundamentava as decisões tomadas por meio de seus rescritos, respostas dadas às consultas que lhe eram endereçadas por particulares, magistrados, funcionários, corporações e comunidades citadinas. Após expor a origem e funcionamento da prática dos rescritos imperiais e discutir o fundamento de sua força normativa, assim como a forma pela qual se tornavam fonte do direito, o trabalho esboça uma espécie de teoria geral da motivação das decisões na experiência jurídica romana e apresenta uma tipologia dos argumentos empregados por Marco Aurélio em seus rescritos. A análise das fontes selecionadas permite entrever uma rica gama de formas de raciocínio, em que sobressaem as considerações de ordem utilitária e benevolente, correspondentes à concepção do bom princeps que se deseja apresentar aos habitantes do império e destinatários das decisões.

This thesis seeks to show the way in which the emperor Marcus Aurelius justified the decisions taken through his rescripts, answers given to consultations made by private citizens, magistrates, officials, corporations and cities. After exposing the origin and working of the imperial rescripts praxis and discussing the ground for its normative force, as well as the way in which they became a source of law, the work outlines a sort of general theory of justification of legal decisions in Roman experience and presents a typology of the arguments employed by Marcus Aurelius in his rescripts. The analysis of the selected sources allows us to capture a rich range of reasoning forms, among which stand out considerations of benevolent and utilitarian order, correspondent to the conception of the good princeps that is sought to be shown to the inhabitants of the empire and recipients of the decisions.
