Esta pesquisa tem por objetivo o estudo da autonomia da vontade da criança e do adolescente na tentativa de se verificar se a teoria das incapacidades, conforme positivada no ordenamento jurídico brasileiro, poderia ser mantida quanto à situações existenciais envolvendo crianças e adolescentes. Para tal, será feita breve análise da ideia de menores como sujeitos de direito, com foco especial para o princípio do melhor interesse da criança e para a doutrina da proteção integral. Ao se estudar a teoria das incapacidades, os critérios da idade e do discernimento, somado à maturidade, serão comparados. Para se chegar à autonomia da vontade de crianças e adolescentes, apresentar-se-á a diferença entre situações patrimoniais e situações existenciais, estas últimas referentes aos direitos da personalidade. Pelo fato de as situações existenciais estarem intimamente ligadas à área médica, estudarse-á a principiologia da bioética. Logo após, adentrando ao tema propriamente dito, será feito estudo comparando capacidade e competência, diferenciando ambas e apresentando-se novos critérios para a análise da autonomia dos menores, inclusive com proposta de alteração do Código Civil brasileiro. Por fim, os critérios sugeridos serão analisados tendo em vista várias situações práticas, ressaltando-se que, embora a ideia tenha surgido com relação à autonomia em vista da saúde e da integridade física, podem os critérios ser aplicados em qualquer situação existencial envolvendo crianças e adolescentes.

This research aims to study the decision-making autonomy of children and adolescentes in an attempt to verify if the theory of incapacities, as affirmed in the Brazilian legal system, could be maintained regarding existential situations involving children and adolescentes. For that, a brief analysis of the idea of minors as subject of law will bem ade, with a special view on the principle of the best interest of child and the doctrine of integral protection. In studying the theory of incapacities, the criteria of age and judgement plus maturity will be compared. To reach the child and the adolescent decision-making autonomy, the difference between patrimonial and existential situations, the later referring to personality rights, will be presented. As existential situations are closely linked to the medical field, the principles of bioethics will be studied. Soon after, already entering the theme itself, capacity and competence will be compared, differentiating both and presenting new criteria for the analysis of the autonomy of minors, including a proposal to amend the Brazilian Civil Code. Finally, the suggested criteria will be analyzed in the view of various practical situations, highlighting that, although the idea has arisen regarding autonomy related to health and physical integrity, the criteria can be applied to any existencial situations involving children and adolescents.
