O presente trabalho propõe a correlacionar a alienação fiduciária em garantia brasileira com institutos jurídicos correlatos da propriedade fiduciária, do negócio fiduciário, da propriedade resolúvel e do patrimônio de afetação, a fim de sanar as confusões terminológicas encontradas na doutrina e legislação acerca dessas figuras. Em pesquisa acadêmica aprofundada, identificou-se que esses institutos se confundem e os efeitos práticos de cada um deles não são claros. Propõe-se também o estudo da fiducia do Direito Romano, que é apontado como origem histórica da alienação fiduciária em garantia, com o objetivo de se validar ou não tal afirmativa. A fiducia romana, no Brasil, tende a ser estudada somente a partir de suas subespécies de fiducia cum amico e fiducia cum creditore, porém será apontada a estrutura do instituto romano para a realização do cotejo com o Direito atual. Por fim, apresentar-se-á a proposta de histórico, conceito, natureza jurídica e efeitos da alienação fiduciária em garantia, confirmando ou refutando sua correlação com os demais institutos mencionados.

Abstract: The present essay proposes to correlate Brazilian fiduciary alienation in guarantee with related legal institutes of fiduciary property, fiduciary business, resolvable property and escrow assets, in order to remedy the terminological problems found in the doctrine and legislation about these figures. In-depth academic research, it was identified that these institutes are confused with one another and the practical effects of each of them are not clear. It also proposes the study of the fiducia of Roman Law, which is pointed out as the historical origin of fiduciary alienation in guarantee, with the finality of validating or not such affirmative. The Roman fiducia, in Brazil, tends to be studied only from its subspecies of fiducia cum amico and fiducia cum creditore, however, the structure of the Roman institute will be analyzed to carry out the comparison with the current Law. Finally, will be presented a proposal of the historical origin, concept, legal nature and effects of fiduciary alienation in guarantee, confirming or refuting its correlation with the other mentioned institutes.
